New Delhi:  As Anna Hazare refuses to end his hunger strike, the government is writhing under the pressure of his frail health and the exacting negotiations that Anna's associates are levying upon senior ministers.

The government will consult with leaders from the BJP and other parties at a meeting this afternoon that will focus on Anna, and his demand that his version of the Lokpal Bill be cleared by Parliament before the current session ends on September 8.   Team Anna wants the government to also withdraw its draft of the Lokpal Bill which was sent for review to a Parliamentary committee last week.

Any exit route for the government from the Anna  crisis will need considerable support from the Opposition, who has repeatedly said that till the Anna crisis peaked, the government had made no effort to include it in the talks for the creation of a Lokpal or independent agency in charge of handling corruption among public servants.

In the Rajya Sabha today, BJP leader Arun Jaitley's statement indicated the conundrum that all parties face - how to balance Anna, the ostentatious and ceaseless support for him from across the country, and the need to protect Parliament's exclusive right to legislate. 

"While we are in this delicate situation, and we are discussing issue of corruption, I believe that this opportunity presents a historic challenge to us.  Parliament is the ultimate law-making authority...movements outside Parliament are all intended to convey public opinion and the intensity of public opinion to us," Mr Jaitley said.  "That message coming to all of us could not be louder and clearer.  That the country is expecting Parliament to perform its obligation and duty and take effective steps so we are able to substantially tackle the problem of corruption."

New Delhi:  The Rajya Sabha voted today to impeach Calcutta High Court judge Justice Soumitra Sen.

In the first televised impeachment proceedings ever, the Upper House voted 172 to 17 in favour of Justice Sen's impeachment. The motion was first passed by voice vote and then through division.

Since the motion was passed by more than two-thirds of the members present and voting, it will now go to the Lok Sabha within a week. If it is approved by both the Houses of Parliament in the same session, the motion would go to the President, who can order the removal of the judge from office.

A special committee constituted by Rajya Sabha chairman Hamid Ansari had found charges of financial irregularities against Justice Sen to be correct. He is accused of misappropriating nearly Rs. 24 lakh in the 1990s when he was a lawyer and was appointed receiver by the Calcutta High Court.

He is the first High Court  judge to face impeachment proceedings in the Upper House

Earlier today, Senior BJP leader Arun Jaitley tore into  Justice Soumitra Sen's  defence, saying that the latter had misled the House.  The 53-year-old judge had claimed that he was being made a "sacrificial lamb" while facing impeachment proceedings in the Rajya Sabha yesterday.

Mr Jaitley, who is the Leader of the Opposition in the Rajya Sabha, supported the motion moved by CPI(M) leader Sitaram Yechury for Justice Sen's removal and said that he had gone through the entire evidence in the judge's case and found it to be in tandem with the inquiry that proved misappropriation of funds by Justice Sen. New Delhi: The first impeachment proceedings against a judge was taken up in the Rajya Sabha on Wednesday which converted into a court to take up a motion against Justice Soumitra Sen of the Calcutta High Court.

Justice Sen appeared before a 'bar' "posted" at the gate of the central aisle of the upper house facing the Chairman as CPI-M leader Sitaram Yechury moved motions against him. 

The first of the two grounds of misconduct against Sen being cited in the motion is misappropriation of large sums of money, which he received in his capacity as receiver appointed by the high court. 

The second ground is that he misrepresented facts with regard to the misappropriation of money before the High Court. 

Moving the motions, Yechury said he was doing so with "deep sense of anguish and the move was not against the judiciary, which we hold high esteem but against a judge for his misbehaviour."

New Delhi: Illegal mining activities witnessed a sharp spike in the country during 2010, with 82,330 cases detected by law enforcement agencies during the year, almost double the 41,578 cases unearthed in 2009, Parliament was informed.

The rate of illegal mining appears to be accelerating, as government agencies detected as many as 24,405 cases in the first three months (January-March) of 2011, almost 30 per cent the number of such activities seen in the whole of 2010, Mines Minister Dinsha Patel said in a written reply to the Rajya Sabha.

In his reply, Patel said that in 2010, the highest number of illegal mining cases were reported in Maharashtra, at 34,384, which accounted for about 41.64 per cent of the cases registered across the nation during the year.

The number of cases detected in Maharashtra in 2010 was 4.14 times the number seen in 2009, when 8,270 cases were reported.

However, he did not specify the minerals for which large-scale illegal mining activities were taking place.

Illegal mining activities in Karnataka, which is under the Supreme Court scanner, have risen by 2.93 times, with 4,949 cases reported in 2010, as against 1,687 such incidents in 2009.

Similarly, other mineral-rich states like Andhra Pradesh and Chhattisgarh have also reported a huge rise in illegal mining cases, reporting 17,882 and 2,942 cases, respectively, in 2010. These are about 1.54 times and 2.72 times higher than the 2009 figures for the respective states.

The above four states accounted for almost 73 per cent of the illegal mining cases lodged in 2010, at 60,057, data provided in Patel's reply shows.

It further said that illegal mining activities have been continuously rising and between January and March this year, with 10,349 cases detected in Maharashtra alone, about 30 per cent of the total number of cases reported in 2010.

Moreover, Karnataka reported 1,263 illegal mining cases between January and March this year, 25 per cent of the 2010 figure for the state.

CWG SCAM: Cong. protests BJP remark on Sonia, forces RS adjournments!

Stung by the Bharatiya Janata Party’s slogans against United Progressive Alliance chairperson Sonia Gandhi, Congress members on Tuesday forced repeated adjournments of Rajya Sabha disallowing Leader of the Opposition Arun Jaitley to complete his speech during a debate on the Commonwealth Games.

The Opposition and the Treasury benches clashed frequently during the Short Duration Discussion initiated by Mr. Jaitley, who attacked Prime Minister Manmohan Singh for appointment of Suresh Kalmadi as chairman of CWG Organising Committee.

Mr. Jaitley also referred to Mr. Kalmadi’s objections to the government interference in his work.

The BJP leader mentioned Mr. Kalmadi’s letter to the Prime Minister’s Principal Secretary in 2007 in which it was stated that his appointment as OC chief followed “a series of meetings” with the UPA chairperson and the Prime Minister.

When Mr. Jaitley made these remarks, his party colleagues resorted to slogan shouting, using certain words against Ms. Gandhi, which the Congress members strongly objected.

New Delhi:  An uproar in both the Lok and Rajya Sabha had caused both Houses to be adjourned today. But while the Lok Sabha remains adjourned, normal service resumed in the Rajya Sabha, post-noon.

The BJP continued their attack on the Congress over Union Sports Minister Ajay Maken's statement last week. Mr Maken had then said that Kalmadi - who is now in prison for charges of corruption during the Commonwealth Games - had been appointed to be in charge of the Games during the NDA regime.

Leader of the Opposition in the Rajya Sabha, Arun Jaitley, countered Maken's statement saying it was ridiculous for the Congress to blame the BJP for Kalmadi's appointment. He added that there was an attempt by the Congress to hide all facts relating the Games. '' The Commonwealth Games was a monumental deception. If heads are to roll then it must be heads of this government.''

Accusing the government of trying to suppress scams, Opposition members in the Rajya Sabha were on Friday furious at not being given copies of the five reports of the Comptroller and Auditor General (CAG), including on the Commonwealth Games (CWG) and fertiliser subsidies.

Interrupting zero hour, Bharatiya Janata Party (BJP) leader S.S. Ahluwalia said the government was trying to suppress information related to the scams. “The reports have not been made available to the members, how has it been tabled? It is Friday and most members will leave for their constituency. If they don’t get it now, it will be suppressed till Monday,” he said.

The reports on the CWG, fertiliser subsidies, functioning of the coast guards, the railways, and on autonomous bodies of union government were presented in Parliament Friday.

The Supreme Court on Tuesday dismissed Sikkim High Court Chief Justice P. D. Dinakaran’s plea for restraining the Campaign for Judicial Accountability (CJA) from participating in the inquiry by a Rajya Sabha-appointed panel into his alleged corrupt practices and misconduct.

“The petition is dismissed,” a bench of Justices G. S. Singhvi and C. K. Prasad said in a terse order after hearing Mr. Dinakaran’s counsel for over half an hour at a special hearing.

Senior counsel Amarender Sharan and Ashok Bhan, appearing for Mr. Dinakaran, submitted before the bench that the CJA had no locus standi and should not be allowed to lead evidence or participate in the inquiry.

The counsel cited two apex court judgements to claim that third parties have no right of participation nor shall they be allowed to participate in impeachment proceedings.

The CJA had been in the forefront seeking removal of Mr. Dinakaran for his alleged corrupt practices.
