Trial of former Egypt President Hosni Mubarak and sons adjourned until September 5 to allow them to be tried with ex-interior minister Habib el-Adly and six ministry officials.

An Egyptian judge on Monday adjourned the trial of former president Hosni Mubarak and his two sons until September 5 and banned live broadcasts of it.
The judge made his decision during the second session of the trial, after the first session earlier this month.
Judge Ahmed Refaat adjourned the trial in order to combine it with that of ex-interior minister Habib el-Adly and six ministry officials. All defendants are charged with ordering the killing of protesters earlier this year during protests that led to the ouster of Mubarak.
At least 850 protesters were killed in the uprisings during January and February of this year, and over 6,000 were injured.
Ahmed Fawzy, the head of the Egyptian Association for Community Participation Enhancement, said that the decision to halt live broadcast of trials came at the right moment after two days of chaos inside the court.
“This is definitely in the interest of the case," Fawzy told the German Press Agency DPA.
On Monday, a dispute between lawyers of both sides took place inside the hall while the judge was in recess. There are roughly 200 lawyers representing hundreds of plaintiffs.

The day before, Refaat adjourned the case of el-Adly after chaos erupted due to interruptions by plaintiff's lawyers.

DMK chief took a dig at the Chief Minister for holding the Vigilance portfolio while facing a probe - PTI file photo
DMK chief took a dig at the Chief Minister for holding the Vigilance portfolio while facing a probe - PTI file photo.

DMK president M Karunanidhi has taken a swipe at chief minister Jayalalithaa for holding the vigilance portfolio even though the state vigilance department was conducting a case of disproportionate assets against her in a Bangalore court.

She must emulate her Kerala counterpart Oommen Chandy, who had relinquished the vigilance portfolio after a court ordered probe in a palmolein import case, Mr Karunanidhi wrote in his party organ Murasoli.
“When a vigilance probe is on against her, it is entirely improper for her to hold the portfolio. The Kerala chief minister had not only relinquished the vigilance portfolio but also offered to legally face the case. One has to have the courage to say that”, the DMK chief said.
Mr Chandy shed the vigilance portfolio last week after a court directed that his role be investigated in the palmolein import deal in 1992, when he was the Kerala finance minister in the Karunankaran government.
Responding to Ms Jayalalithaa’s allegation that he had ‘merely enacted a drama’ when he held a three-hour fast on the Sri Lankan Tamil issue, Mr Karunanidhi listed out the various steps he had taken since 1956 when he first proposed a resolution in support of the Sri Lankan Tamils in the DMK general council meet under its founder, the late Annadurai.

U.S. IMPROPER LOBBYING CASE: Fai case referred to grand jury!

Press Trust Of India / ibnlive.in.com / Posted on Aug 13, 2011 at 12:08pm IST.

Washington: The case of Kashmiri separatist Syed Ghulam Nabi Fai, who has been charged by the FBI of being an undeclared agent of Pakistani spy agency ISI in the US, has been referred to a grand jury which will determine if there is enough evidence for a trial.

"The matter has been referred to the grand jury, so no further hearings are scheduled pending action by the grand jury," an official of the US District Court in Alexandria, Virginia, told PTI.

A grand jury is traditionally larger than and distinguishable from a 'petit' jury or the trial jury, which is used during a trial.

Grand juries carry out their job by examining evidence and issuing indictments, or by investigating alleged crimes and issuing presentments.

The court official said it is the grand jury which will determine if there is enough evidence for trial against Fai, who is currently under house arrest with electronic surveillance at his residence in Fairfax, an effluent suburb of Washington.

Fai heads the Washington-based Kashmiri American Council (KAC).

Meanwhile, following an appeal by the prosecution, the Alexandria court hearing the case ordered that the defence would not make any of the classified information public without the consent of the court.

Assistant United States Attorney, Gordon D Kromberg, had moved a motion for protective order, seeking an order by the court to ensure that secret evidence and information in the case are not disclosed by Fai's attorneys.

Kromberg said Fai has been charged by criminal complaint with conspiring to act as an agent of a foreign principal without registering with the Attorney General, and to falsify, conceal, and cover up material by tricks, schemes, and devices, in this matter. By foreign principal, Kromberg meant the Inter-Services Intelligence (ISI) of Pakistan.

Mr. Mubarak, his former Interior Minister Habib el-Adly, and six top police officers are charged with murder and attempted murder in connection with the protesters killed during the uprising, according to the official charge sheet. All eight could face the death penalty if convicted.
In a historic trial, an ailing, 83-year-old Hosni Mubarak, lying ashen-faced on a hospital bed inside a metal defendants’ cage with his two sons beside him in white prison uniforms, denied charges of complicity in the killings of protestors and of corruption.

The spectacle, aired live on state television, was the biggest humiliation for Egypt’s former president since his ouster nearly six months ago. But it went a long way to satisfy one of the key demands that has united protesters since Feb. 11, the day the regime was toppled.
It was the first time Egyptians have seen Mubarak since Feb. 10, when he gave a defiant TV address refusing to resign.

“I am delighted that I see them in a cage. I feel that my son’s soul is finally starting to be at rest and that his blood will cool,” said Saeeda Hassan Abdel-Raouf, the mother of a 22-year-old protester who was among those killed in the uprising. She spoke outside the trial venue at a Cairo police academy.

Mr. Mubarak, his former Interior Minister Habib el-Adly, and six top police officers are charged with murder and attempted murder in connection with the protesters killed during the uprising, according to the official charge sheet. All eight could face the death penalty if convicted.

Separately, Mubarak and his two sons – one-time heir apparent Gamal and wealthy businessman Alaa - face charges of corruption. The two sets of charges have been lumped together in one mass trial.

Outside the police academy where the trial was being held, hundreds of Mubarak’s opponents and angry supporters scuffled sporadically, throwing stones and bottles at each other while riot police with shields and helmets tried to keep them apart. About 50 supporters pounded on the steel gate trying to get into the compound, chanting “We Love you, Mubarak!” until police charged at them with electrified batons and dispersed them.

The clashes were a sign of the profound emotions stirred by the unprecedented prosecution of the man who ruled Egypt with unquestioned power for 29 years.

For many Egyptians, the trial is a chance at retribution for decades of oppressive rule in which opponents were tortured, corruption was rife, poverty spread and political life was stifled. But for others, Mr. Mubarak was a symbol of stability.

Mr. Mubarak was wheeled into the defendant’s cage on a hospital bed, a sheet pulled up to his chest alongside his nine co-defendants, including his sons Mr. Gamal and Mr. Alaa, his former interior minister Habib el-Adly and six top former police officials. Though he was pale and his eyes were ringed with red, he appeared alert and aware of what was going on. He showed little discernible emotion.

From time to time, Mr. Mubarak craned his head to see the proceedings. Other times, he crooked his elbow over his face as if in exhaustion. While the other defendants sat on wooden benches in the cage, Mr. Gamal and Mr. Alaa stood protectively next to their father’s bed in their white prison uniforms, leaning over at times to talk to him.

Defendants are traditionally held in cages during trials in Egypt. About an hour after the session began, there was a recess and the defendants were led out of the cage.

A success for the revolution

Up to the last minute, many Egyptians had doubted that Mr. Mubarak would actually appear at the trial. It was inconceivable that the man who vowed to rule the country until his last breath and who kept a near total grip on the levers of power, whose name once crowned public buildings around the country, could actually be brought to trial.

HOSNI MUBARAK TRAIL: Extraordinary Precautions Taken for Mubarak Trial!

By HEBA AFIFY, / nytimes.com / Published: August 2, 2011.

CAIRO — Egypt’s interim military government took strong preventive steps on Tuesday to secure the trial location where Hosni Mubarak, the deposed president, was scheduled to face charges of corruption and the killings of Egyptians during the tumultuous 18 days of revolution that led to his forced resignation nearly six months ago.

The prospect that Mr. Mubarak, a former Arab strongman who for nearly 30 years routinely imprisoned political adversaries, would now be called to account in a public trial televised live has transfixed Egypt and much of the Arab world. Many Egyptians remained skeptical that it would actually happen in the final hours before the scheduled start on Wednesday morning. A conviction could carry the death penalty.
The Ministry of Interior and the Army said 5,000 soldiers and officers backed by 50 tanks and armored vehicles would be deployed along the route where Mr. Mubarak and his co-defendants, including his two sons, would be transported to court as well as the court itself, a Cairo police academy. Officials said barbed wire would ring the police academy to stop intruders, and security forces would surround the facility’s outer fence.
No one will be allowed inside except the 600 people with the permits, plus civil rights lawyers and a small number of the families of victims of the Mr. Mubarak’s failed effort to crush the revolution.
Officials said their security plan included ways to ensure separation between the people attending the trial and the accused, to avoid any verbal or physical assaults on the defendants themselves.

  • From:

  • THE alleged mastermind of the terrorist attacks on September 11, 2001, is a step closer to trial in a US military tribunal after a new round of charges was filed against him.

  • Prosecutors filed charges yesterday of murder, terrorism and hijacking against Khalid Shaikh Mohammed and four others for their role in plotting the attacks that killed almost 3000 people.

If the trial proceeds as planned, Khalid and his alleged co-conspirators will face a military commission hearing inside the Guantanamo Bay prison at a US navy base in Cuba.
The Obama administration confirmed in April that it had abandoned earlier plans for the five men to be tried in a New York federal court in lower Manhattan.
How many more are there, yet to be prosecuted?

Pak aims to block lawsuit against ISI chief in US court!

Brickbats, Bouquets & Backfeeds are welcome on prmadhura@yahoo.com

ISLAMABAD: Pakistan is preparing to block a lawsuit in a US court that alleges complicity of its spy chief Lt Gen Ahmed Shuja Pasha in the audacious 2008 Mumbai terror attacks, on the grounds that it will pour "gasoline on the fire" of Indo-Pak relations.

The country's military-run ISI has roped in American lawyers, who are moving to quash the lawsuit in a Brooklyn court by arguing that if the case proceeds, it "will fuel violence and extremism" that will threaten Pakistan government and pour "gasoline on the fire" of relations between Pakistan and India, NBC News reported.
