Slamming military authorities for misappropriating prime defence land for the Adarsh housing society, the CAG has said rules were bent to benefit relatives of politicians, public servants and senior Service officers including former Army chiefs Gen Deepak Kapoor and N.C. Vij.

In a report tabled in Lok Sabha on Tuesday, the Government auditor also targeted the Union Environment Ministry and the Maharashtra Urban Development Ministry saying indications were there that procedures were skirted to enable grant of No-Objection Certificate (NOC) to the Adarsh Cooperative Housing Society (ACHS) in Mumbai.

The CAG said welfare of servicemen and ex-servicemen was used as a ruse to grab piece of public land for the Society.

It said the entire episode reveals “glaring examples of dereliction of duty and severe lack of probity and accountability which needs to be seriously investigated.

“Action of the Local Military Authorities acting in collusion with Defence Estates Organisation (DEO) enabled misappropriation of prime government land in Mumbai for the benefit of a select few,” it said.

Expressing displeasure over CBI's inaction in the probe into the Adarsh Society missing files case, the Bombay High Court on Wednesday directed the agency to speed up its investigation and show some "results".

"We are very displeased. You (CBI) please do the investigations properly and get results. Reasons like officers are busy cannot be accepted," a division bench of justices Ranjana Desai and R V More remarked while hearing a public interest litigation filed by one Mahendra Singh.

The court also expressed anger over the fact that four accused got bail as the CBI did not file its charge sheet on time.

The court's remarks came when CBI counsel D N Salvi informed that certain hard disks seized from the office of the Urban Development department in Mantralaya, from where the files went missing, are yet to be sent to the Forensic Science Laboratory (FSL) in Hyderabad.

According to CBI, while duplicates of the certain pages have been found, probe is still on to find out the missing notesheets pertaining to Adarsh Society. "The notesheets were typed in some computers, the hard disks of which have been seized with a view to retrieve the material," Salvi said.

The Central Bureau of Investigation (CBI) on Sunday recorded the statement of Union Power Minister Sushil Kumar Shinde, also a former Chief Minister of Maharashtra, in Adarsh housing society scam case.

Sources in the CBI said that Mr. Shinde’s statement was recorded as he had accepted a proposal, during his tenure as Chief Minister, recommending 40 per cent allotment of flats in Adarsh Housing Society to civilians in Mumbai which was meant for Kargil victims.

A team of CBI officials from Mumbai had reached the Capital and quizzed Mr. Shinde at his residence on the reasons for clearing the file sent by Ashok Chavan, who was Maharashtra Revenue Minister during 2003-04 period as well as grant of certain sanctions to the Adarsh society, located in the upscale Colaba area of Mumbai.

Though the CBI remained tightlipped about knocking at Union Power Minister’s door, interestingly the investigating agency’s action came on the eve of the beginning of Monsoon session of Parliament.

The multi-crore housing scam has already led to the resignation of Mr. Chavan as Chief Minister. The Congress leadership replaced Mr. Chavan with Mr. Prithiviraj Chavan who was Minister of State in the Prime Minister’s Office (PMO).

The Bombay High Court today dismissed a petition filed by the controversial Adarsh Housing Society seeking de-freezing of its bank accounts.

The CBI had in January frozen two bank accounts of the Society after registering a case against 14 accused including several members of the society.

A division bench of justices Ranjana Desai and R.V. More was hearing a petition filed by the Society seeking de-freezing of its two bank accounts with the State Bank of India, Cuffe Parade and Wodehouse Road, to bear legal expenses and day-to-day expenditure of the Society. The accounts have deposits approximately worth Rs 2 crore.

• Maps and some survey sheets from 1872-1960 related to Adarsh land and surrounding Colaba areas have gone missing from the land records office of the city, the fourth such instance of files related to the controversial society going missing.
  The two-member Commission, probing the housing society scam, was told by Sanjay Dikhle, Superintendent of City Survey and Land Records, that historical maps of 1847 (the first time when Mumbai was mapped scientifically) and 1882 were "not available" in his office.

Mumbai, May 21 (PTI) Chief promoter and secretary of the controversial Adarsh Housing Society has told a judicial panel, probing the scam, that the complex was proposed much before the Kargil war and hence the reports of it being reserved for war heroes and their widows are false.

R C Thakur, a former officer with the defence estates office and an accused in the case, in an affidavit filed before the two-member inquiry Commission has said, "The Society was proposed much prior to the Kargil war and hence there was no question of it being reserved for Kargil war heroes and their widows."

The affidavit relies on a letter of intent dated January 18, 2003 issued by the Maharashtragovernment which does not impose any such condition on the Society in posh Colaba area.

OK, granted, Mr. Thakur,  assuming you have documentary evidence to prove this point apart from your mere affidavit, Adarsh Housing Society is still violator of the following:

01)  Building a high rise in the CRZ (Coastal Regulation Zone), a crime against the national defense and environment;

02)  Building 25 floors  more than the permitted level is a crime under the relevant urban development rules;

03)  Allocating flats - on out of turn basis - to the Sr. Officials of Defense & Civil Services and relatives of Politicians, again another crime; and finally,

04)  Building such a massive structure without the clearance of the Ministry of Environment and Forests, Union of India is also an unpardonable crime.

In yet another case, key files related to the Adarsh Housing Society went missing from the office of the union ministry of environment and forests, Central Bureau of Investigation officials said Saturday. “Many files related to the scam-tainted Adarsh Society have gone missing from the MoEF office in New Delhi,” the official told IANS.

With sleaze money around why only files, Tomorrow witnesses too would go missing!
