Adarsh Society was proposed much prior to Kargil, panel told! OK, So What?

Mumbai, May 21 (PTI) Chief promoter and secretary of the controversial Adarsh Housing Society has told a judicial panel, probing the scam, that the complex was proposed much before the Kargil war and hence the reports of it being reserved for war heroes and their widows are false.
R C Thakur, a former officer with the defence estates office and an accused in the case, in an affidavit filed before the two-member inquiry Commission has said, "The Society was proposed much prior to the Kargil war and hence there was no question of it being reserved for Kargil war heroes and their widows."
The affidavit relies on a letter of intent dated January 18, 2003 issued by the Maharashtragovernment which does not impose any such condition on the Society in posh Colaba area.
OK, granted, Mr. Thakur,  assuming you have documentary evidence to prove this point apart from your mere affidavit, Adarsh Housing Society is still violator of the following:
01)  Building a high rise in the CRZ (Coastal Regulation Zone), a crime against the national defense and environment;
02)  Building 25 floors  more than the permitted level is a crime under the relevant urban development rules;
03)  Allocating flats - on out of turn basis - to the Sr. Officials of Defense & Civil Services and relatives of Politicians, again another crime; and finally,
04)  Building such a massive structure without the clearance of the Ministry of Environment and Forests, Union of India is also an unpardonable crime.
