MOHAMMEDAN LAW: Muslim heirs can’t relinquish right: SC!

In a significant verdict on the rights of the children of a Muslim father in his property, the Supreme Court has held that none of his sons or daughters can relinquish right in the property under the Mullah’s Principle of Mohammedan Law. According to “paragraph-54” of the MPML a Muslim heir “is not entitled in law to relinquish

an expected share in father’s property”. While applying the principle in a property dispute between three sons and three daughters of Meeralava Rawther from Kerala, who died in 1986, a bench of Justices Altamas Kabir, Cyriac Joseph and S.S. Nijjar said, “A Mohammedan cannot by will dispose off more than a third of his estate after payment of funeral expenses and it is being avoided by the consent of all the heirs. In effect, the same also amounts to a right of relinquishment of future inheritance, which is on one hand forbidden and on the other accepted in the case of testamentary disposition.”

On “testamentary disposition”, the top court explained that under the MPML “a Muslim may make a disposition of his entire property if all the heirs signified their express or implied consent.” But after his death, no single heir could claim that the father had disposed the property in his or her favour during his lifetime. Acceptance of such a doctrine would go against the “public policy” guiding the Mohammedan Law.

CWG SCAM: CBI starts property attachment of accused!

The CBI today began attachment of properties of three absconding accused in connection with irregularities in the award of a contract to a Swiss firm during the Commonwealth Games causing a loss of over Rs 95 crore to the exchequer.
In its charge sheet, CBI has accused Anil Madan and P D Arya of Faridabad-based Gem International and A K Reddy of Hyderabad-based AKR Constructions of conniving with the Organising Committee officials to get the contract awarded to Switzerland-based Swiss Timing at Rs 157.62 crore, ignoring the bid of a Spanish firm which was for Rs 62.01 crore.
The three accused, however, could not be traced by the agency following which it sought permission to attach their properties from the special CBI court which recently granted them permission, sources said.

HASAN ALI KHAN CASE: ED attaches Hassan's, Kashinath Tapuriahs' property!

The Enforcement Directorate issued a showcause notice for attachment of properties valued at Rs 50 crore of Pune stud farm owner and alleged tax defaulter Hassan Ali Khan and his Kolkata-based associate Kashinath Tapuriah in a money laundering case.

The ED issued the order under the stringent Prevention of Money Laundering Act (PMLA) after it got the approval of the adjudicating authority of the law, which is based in the national capital, and it includes immovable properties in Delhi, Mumbai and Pune of the duo, official sources said.The ED will now begin proceedings for attachment of these properties.

 The immovable property of Hasan Ali attached in Pune includes three floors of the five storeyed "Tulip" building in Koregaon Park area where Ali lived. The court order also attached his movable property,covering six cars including three Mercedes and 32 horses kept at stables of Royal Western Indian Turf Club (RWITC) in Mumbai and Pune, sources said

"An attachment order and showcause notice has been issued to us under the Prevention of Money Laundering Act by the Enforcement Directorate. We will appeal against it," Ali's lawyer RK Gaur said.

The attachment order notice, according to sources, also includes Ali's high-end imported cars, including Mercedes, Porche and others, a flat in Pune's posh Koregaon Park area and a residential building in Mumbai and Tapuriah's property on Prithviraj Road in Delhi.


Pity still there are thousands of crores stashed away abroad which are yet to be confiscated!
