The Supreme Court today reserved its verdict on the bail plea of Sadhvi Pragnya Singh Thakur who is facing charges under MCOCA for her alleged involvement in the 2008 Malegaon bomb blast case.

A bench of judges J M Panchal and H L Gokhale reserved the order after hearing all the parties, including Maharashtra government which opposed the bail plea.

Senior Advocate Mahesh Jethmalani, appearing for Pragnya Singh Thakur, pleaded with the court to grant her bail as she had been subjected to harassment, physical torture and verbal abuses by the Anti-Terrorist Squad (ATS) squad during her "illegal" custody from October 10, 2008 onwards.

Seven people were killed in a bomb blast on September 29, 2008, at Malegaon, a communally-sensitive textile town in Nasik district of Maharashtra. The probe into the blast had brought into focus the alleged involvement of some right-wing Hindu groups.

Jethmalani submitted Ms. Thakur was entitled to bail as Maharashtra's ATS had failed to file the charge sheet against her within the mandatory 90 days of her arrest on October 23, 2008.

Maharashtra government counsel Asha Nair, however, took the plea that Ms. Thakur was arrested on October 23 and produced before a magistrate as required under the law.

Ms. Pragnya approached the apex court challenging refusal of bail by the Bombay high court.

The high court had ordered that Pragnya and ten other accused in the Malegaon bomb blast case will face trial under MCOCA (Maharashtra Control of Organised Crime Act) and had quashed the decision of the special court which had dropped the charges under the special law.

A special MCOCA court had on July 31 last year ruled that the Anti Terrorist Squad had wrongly applied MCOCA in the case against Pragnya and ten others.

CWG SCAM: CBI starts property attachment of accused!

The CBI today began attachment of properties of three absconding accused in connection with irregularities in the award of a contract to a Swiss firm during the Commonwealth Games causing a loss of over Rs 95 crore to the exchequer.
In its charge sheet, CBI has accused Anil Madan and P D Arya of Faridabad-based Gem International and A K Reddy of Hyderabad-based AKR Constructions of conniving with the Organising Committee officials to get the contract awarded to Switzerland-based Swiss Timing at Rs 157.62 crore, ignoring the bid of a Spanish firm which was for Rs 62.01 crore.
The three accused, however, could not be traced by the agency following which it sought permission to attach their properties from the special CBI court which recently granted them permission, sources said.

The Delhi high court on Tuesday dismissed the anticipatory bail plea of three promoters of private companies who are accused of being involved in financial irregularities ahead of the Commonwealth Games and are on the run.

The three are Anil Kumar Madan and Purushottam Dev Arya of Faridabad-based Gem International and Hyderabad-based entrepreneur A. Krishna Reddy linked to A.K.R. Constructions. “All the three applications are dismissed,” said Justice Mukta Gupta, adding that at this stage it was not fit to give them relief. Madan approached the court for anticipatory bail on the ground that he was old, infirm and a handicapped person suffering from life-threatening ailments. “In January, he lost vision in his left eye because of retinal detachment and retinal detachment in the other eye is in progress,” said his application, adding that he also suffered from severe heart ailments. In its first charge sheet, the CBI said Madan and Arya, the authorised Indian representatives of Swiss Timing, which was fraudulently awarded the contract for the timing, scoring and result (TSR) equipment, were personally known to former CWG organising committee (OC) chairman Suresh Kalmadi long before the sporting event.

The Bombay high court has reserved the judgment on the bail pleas of seven convicts in the 2002 Bilkis Bano gang-rape case. All the seven were sentenced to life imprisonment by the trial court in 2008 following which they have filed appeals against the verdict and sought bail pending the disposal of appeals.

The high court has already admitted an appeal filed by the Central Bureau of Investigation, seeking death penalty for three of the convicts. The arguments concluded before the division bench of Justices N H Patil and Mridula Bhatkar on Friday.

On March 3, 2002, Bilkis Bano's family was attacked by a mob at Randhikpur village, about 250 kms from Ahmedabad [ Images ], during the post-Godhra riots.
