“The Mayawati Government had erred in acquiring the land by denying the land owners their right to raise objection”
In a fresh jolt to the Mayawati Government in Uttar Pradesh, the Supreme Court on Wednesday quashed the State's move to acquire private land by invoking the “emergency clause” in Jyotiba Phule Nagar for construction of a district jail.
A Bench of Justice G. S. Singhvi and Justice H. L. Dattu said the State had seriously erred in acquiring the land by denying the land owners their valuable right to raise objections and being heard to express their grievances.
The Court had recently quashed the State Government's acquisition of vast tracts of land in Noida, a decision which had hit hard major real estate developers and thousands of house owners who had invested in these projects.

In yet another setback to Mayawati government, the Allahabad High Court today quashed acquisition of nearly 600 hectares of land in two villages in Greater Noida.
Acting on a batch of petitions by farmers, a division bench comprising Justice Sunil Ambawani and Justice S.S. Tiwari set aside the acquisition of 589.13 hectares of land in Patwari and Dewla villages, falling under Dadri tehsil of Gautambuddh Nagar district.
The land was acquired by the state government through notifications in March 2008 and May 2008 for building residential complexes in Greater Noida area neighbouring Delhi.
The order came barely a fortnight after the Supreme Court had struck down acquisition of 156 hectares of land by the state government in village Shahberi in the area, saying the authorities were 'subserving' private builders in the name of public interest.
The apex court had on July 6 upheld the Allahabad High Court order which had quashed the land acquisition by the Greater Noida Industrial Development Authority under the urgency clause of the Land Acquisition Act and directed that the property be returned to the farmers.

New Delhi:  On his first day as Minister of Rural Development, Jairam Ramesh has taken the Prime Minister head on over the Land Acquisition Bill.  

Mr Ramesh said today that he has accepted the recommendations of the National Advisory Council, headed by Sonia Gandhi, on the Bill. The government had last week indicated that it would not accept several guidelines mooted by the NAC.  At that time, Vilasrao Deshmukh handled the Rural Development Ministry. 

Mr Ramesh said a draft of the new bill will be placed online next week for feedback, and that the Bill will then be introduced in the monsoon session of Parliament which starts on August 1.

Amid stiff resistance to Posco steel project, Orissa government on Tuesday said talks were on with agitators to resolve the issue as work at proposed plant site near Paradip was stalled for the third consecutive day due to a road blockade at a key junction.
“The district administration of Jagatsinghpur is holding talks with villagers in the proposed Posco plant area to convince them about benefits of the project,” Chief Secretary B K Patnaik told reporters here.
To a query, he said there is no proposal at present for discussion at the chief minister’s level as talks are being held between the district administration and locals on a regular basis to resolve the issue.
Talks with protesters assumed significance as work at the proposed Posco site in Jagatsinghpur district was stalled for the third day with locals staging a road blockade at a key junction pressing for their demands including enhanced compensation to land losers.
“People have blocked the road near Balisahi making it difficult for our teams to proceed for boundary wall and rehabilitation colony construction,” Basudev Prodhan, Tahasildar of Kujang said.


Good, let the project owners pay fair market price for the lands being acquired and also assure a secured 'Resettlement and Rehabilitation' Package to all affected farmers OR provide equivalent land of the same productivity, elsewhere!

Project, however, big in terms of investments shouldn't be encouraged in the name of FDIs, when they create far less industrial jobs than they take away the agricultural jobs!!

After all, every economic developemental activity should assure inclusive growth to all the stake-holders!!!

Orissa government on Monday declared ‘use of kids’ in anti-Posco agitation as illegal after redeploying force close to the dharna site at Gobindpur village, the entry point to Dhinkia area.
Armed police force which had been withdrawn from near the dharna site last week, was again deployed as the State government decided to resume the land acquisition work for the Rs. 52,000 crore project soon.
“We have asked the agitators to clear the road to enable police and officials to move into Dhinkia area.
Preventing government officials from performing their duties is unlawful,” Jagatsinghpur S.P Devadutta Singh told PTI adding protestors should respect law of the land.
Chief Secretary B. K. Patnaik said, “It is illegal to use children in the agitation.

Social activist Swami Agnivesh on Saturday said peaceful settlement of Posco impasse was possible through talks and offered to work as a facilitator between Orissa government and anti-Posco agitators.
“Peaceful settlement of the Posco issue is quite possible. I am willing to play the role of a facilitator for talks between the State government and agitators for a solution,” Swami Agnivesh told PTI.
Expressing solidarity with the anti-Posco agitators, he said there would be no displacement and no loss of fertile land if both the State government and Posco agreed to shift the plant site. It was wrong to allow a multi-national company to have its captive port.
Agniveshji, first and foremost, kindly ascertain that the land being acquired by POSCO, for its Steel Plant is absolutely needed and not a cent of land is being acquired, for real-estate purpose!
please remember that at stake is their sole-means of livelihoods!!
And a sustainable resettlement and rehabilitation must be assured to all the affected families!!!

NOIDA FORCEFUL LAND ACQUISITION SCAM: Court strikes down!

Allahabad, May 30 (IBNS): The Allahabad High Court on Monday revoked the acquisition of 170 hectares of land in the Gulistanpur village of Greater Noida in yet another blow to Chief Minister Mayawati’s Uttar Pradesh government, already facing unrest over the issue.


The land, acquired by the Greater Noida authority for "Planned industrial Development" in February 2008 for a promise of Rs 132 crores to 656 farmers by invoking an ‘urgency clause’, triggered controversy and protests.

Farmers had objected to the move since the land had been acquired under a special clause that allowed the government to buy land from farmers for public purposes, in a virtually dictatorial manner without inviting objections.


There is no urgency, save self-enriching by those involved of all sections, at the cost of the poor farmers!
