Adding to the political heat, Governor H.R. Bhardwaj on Sunday indicated that he will give a report comprising his opinion to President Pratibha Patil soon after the Lokayukta's final report on illegal mining, which has indicted Chief Minister B.S. Yeddyurappa and four Ministers, is officially submitted.

Replying to queries from presspersons if the Lokayukta's report on illegal mining — which exposes the nexus between those in the government and mining lobby — is a fit case for recommending President's Rule in the State, the Governor remarked: “I have not received any request from either side (ruling or the Opposition parties) on whether this warrants President's Rule or anything.”

Pointing out that the report was yet to be officially submitted by the Lokayukta and the information related to indictment of the Chief Minister and other Ministers has been learnt only through media reports, he said: “All these things are coming in the press.”

Phone-tapping

Even as the Opposition parties have appealed to him to initiate action with respect to Justice Hegde's allegations that his telephones were being tapped, the Governor said he could not intervene in the matter.

Spelling more trouble for the Karnataka Chief Minister, Governor H.R. Bhardwaj on Friday indicated that he would take action on the recommendations of State Lokayukta on illegal mining, which had indicted B.S. Yeddyurappa.

“…Whatever he (the Karnataka Lokayukta Justice N. Santosh Hegde) will recommend, I will go according to that. I am not going to do anything (else),” Mr. Bhardwaj told reporters in response to questions on the sidelines of a function in Bangalore.

“I will give my serious thought to whatever he recommends and you will know my action the moment I get the report,” he said, adding, he expects the report to be submitted to the government on Monday.

Mr. Bhardwaj, who has been at loggerheads with Mr. Yeddyurappa, said, “And if as a competent authority, he (the Lokayukta) sends the report to me, then I will deal with it according to the Lokayukta Act (section 12 and 13).”

Asked whether the Chief Minister should resign, he said: “I tell you, you come after two days. You will know every thing”, but hastened to add: “Don’t anticipate. He is the elected Chief Minister. I cannot speak about him unless I see it (the report). How can I reply (now on whether he should resign)?”

Karnataka: Governor Vs. Chief Minister, PM's Assurance!

We will not take any unconstitutional step, says Centre!

NDA delegation meets Manmohan, calls for “immediate recall” of Bhardwaj

NEW DELHI: The Centre on Monday assured a delegation of the National Democratic Alliance (NDA) that it would not resort to any “unconstitutional step” on the recommendation of Karnataka Governor H.R. Bhardwaj for imposition of President's Rule in the State.

The commitment was made by Union Home Minister P. Chidambaram when the delegation led by senior Bharatiya Janata Party leader L.K. Advani called on Prime Minister Manmohan Singh and complained about the “partisan and unconstitutional conduct” of Mr. Bhardwaj, urging Dr. Singh to reject his report.

Mr. Advani told journalists outside the Prime Minister's residence that the delegation also demanded the “immediate recall” of Mr. Bhardwaj for repeatedly indulging in ‘unconstitutional' acts.

“We told Dr. Singh that when the Governor makes a recommendation after meeting him and other leaders at the Centre, it raises doubts about the role of the Union government,” Mr. Advani said.

Asked about Dr. Singh's response to the recall demand, he said the Prime Minister gave the delegation a patient hearing.

Yes, right spirit, Governor H.R. Bhardwaj should be contained or he will bring one more headache to the UPA Government.  The C.M.s continued support of the majority to be decided on the floor of the Assembly and not at the Raj Bhavan.

Post Supreme Court's Ruling, Governor need not hurry to impose President Rule!

Brickbats, Bouquets & Backfeeds are welcome on prmadhura@yahoo.com

It appears Governor of Karnataka, Mr. H.R. Bharadwaj appears to have lost sight of the legal implications of his decision to bring in President's Rule, in that state.

In a Democratically elected Assembly, the Person who enjoys the majority stays as Chief Minister, and as of this state it appears that Mr. B.S. Yediyurappa enjoys the majority, albeit with the support of 11 MLA, who not long ago were illegally disqualified by the Speaker.  The test of it can be conducted only on the floor of the State Assembly and not in the Raj Bhavan or in the 'South Block' (the office of the Union Home Ministry).

His crimes of De-Notifying the Government lands to handover them to his Sons and other Associates can be dealt with the State's Lok Ayukta and other enforcing agencies (State as well as Central) and the Investigating Commissions and if they all fail by the Courts of India.

I hope the UPA's Governor will not commit another Constitutional blunder to right a wrong of his Chief Minister.
