The US court may have acquitted him in the 26/11 case but has nailed ISI’s use of terror

CONSIDERING THAT Tahawwur Rana, a Pakistaniorigin Canadian national could face up to 30 years in prison after a Chicago court found him guilty of having links with the Pakistan-based terrorist organisation Lashkar-e-Toiba (LeT) and plotting a terror attack against a Danish newspaper, the carping noises being heard in India over his acquittal on the charge of facilitating the 26/11 terror attacks in Mumbai sound somewhat incongruous. Rana being found guilty of involvement in 26/11 would not have made it any easier to punish the real masterminds of that outrage, all of whom are comfortably ensconced in Pakistan, some inside jail from where they are conducting their murderous business and others strutting about freely, making hate speeches against India and praying for the soul of Osama bin Laden in public meetings. Nor for that matter is Rana’s acquittal going to be a setback in bringing to justice those who planned and directed that barbaric attack. To put it quite simply, the Rana trial is not really material to the larger 26/11 case.

Rana was at best a bit player in 26/11, who ostensibly was motivated by two factors: one, he believed that by helping the Inter Services Intelligence (ISI) spy on India he would be able to make amends for his desertion from the Pakistan Army; and second, he probably thought that aiding the LeT in the massacre of kafirs (infidels) would earn him some sawab (rewards in the afterlife). His being indicted for involvement in the 26/11 attacks was more of an afterthought, because originally he was arrested for being part of a terrorist conspiracy to attack the Danish newspaper that had published caricatures of Prophet Muhammad. It was only the confessional statement of David Headley that implicated Rana in the 26/11 conspiracy. But the corroborative evidence that was required to back Headley’s testimony was just not adequate for a jury to pronounce the guilty verdict on Rana.

The reaction in India to Rana’s acquittal in the 26/11 case has, however, been quite over the top. Not only does it smack of an utter lack of understanding of law and procedure, it is even devoid of basic common sense. It is one thing for Indian officials to express ‘disappointment’ over Rana’s acquittal, and quite another for them to contemplate filing a chargesheet against both Rana and Headley. Leave aside the fact that it will be practically impossible to secure the extradition of these two characters, there is also the principle of ‘double jeopardy’ that will come into play if these two men are to be tried in India on practically the same charges for which they were tried in the US. But let us, for a moment, assume that India does get hold of these two guys and the issue of ‘double jeopardy’ is not applicable. What, pray, is the new evidence that Indian law enforcement agencies have collected against them (which presumably the American prosecutors did not have) that will stand up in a court of law to convict these two?

WASHINGTON: The US Government will not appeal against a Chicago court verdict which found Pakistani-Canadian Tahawwur Rana "not guilty" on charges related to his involvement in the Mumbai terrorist attacks, a ruling that was received with disappointment by India. 

"After sentencing, Rana may appeal his conviction on the two counts, but the government cannot appeal the jury's finding of NOT guilty on the Mumbai count," a Justice Department official told PTI on Saturday. 

"It is very common knowledge that the law prevents the government from appealing a not guilty verdict. A defendant may appeal a guilty verdict," the official explained, which is quite contrary to the Indian legal system, where both the government and the defendant can appeal against court rulings. 

He would anyway face punishment for other two charges for which he was indicted.

The defence for Tahawwur Rana, co-accused with David Headly in the 26/11 attacks, rested its case here after calling two witnesses but the Pakistani Canadian himself did not testify.
At the hearing of the terror trial, the defence said employees at Rana’s Immigration offices in New York or Toronto did not remember working with Headley. The employees -- Rehana and Kashif Khan -- among others, take calls at the offices.
The defence called in a computer forensic expert and an immigration attorney but Rana waived his right to testify.
Closing arguments by the prosecution and defence are scheduled for Tuesday.
Computer forensic expert Yaniv Schiff Moshe said he researched Rana’s computers from July 1, 2009 to October 15, 2009 and found that no search was conducted on them except on one computer for Jyllands Posten cultural editor Fleming Rose or Kurt Westergaard the cartoonist who drew the controversial cartoons of Prophet Muhammad.
This one computer was used by Headley himself to search the Danish newspaper office and its targets.
But Rana's interrogation tape, released by US Authorities, prove his culpability and active coordination with ISI.
Since he hasn't entered any plea-bargain with USA, he still can be prosecuted by them as a co-conspirator of 26/11, Mumbai Terror Attack!

CHICAGO: Lawyers for Tahawwur Rana, a Pakistani-American businessman charged with having facilitated the November 26, 2008 attacks on Mumbai, say he had no knowledge his immigration business was being used as a cover for the Lashkar-e-Taiba.

Rana's lawyers will argue that he was duped by his childhood friend, the Pakistani-American jihadist-turned-star prosecution witness David Headley, when court proceedings reopen on Tuesday after an extended weekend break.

Deceitful conduct.

Charles Swift, Rana's lawyer, earlier underlined the training Headley received from Pakistan's intelligence services, his less-than-edifying past as a narcotics trafficker and his deceitful conduct with his two wives.

With this defense, Rana's Lawyers can undermine the credibility of Headley, as a witness, but they will not be able to extricate Rana from the charge of having been an accessory to the crime in 26/11 Mumbai Terrorist Attack.

"But Pakistani leadership must now wake up to terror threat"
Self-confessed Lashkar-e-Taiba terrorist David Coleman Headley's ongoing court testimony — in which he has implicated individuals allegedly connected to Pakistan's intelligence agency in the November 2008 terror attack on Mumbai — has not brought out anything India did not already know, Prime Minister Manmohan Singh said on Saturday.

He also said he would continue to use the bilateral dialogue process to press home the demand that Islamabad take action to curb the activities of jihadi groups and would also mobilise world opinion to ensure the “terror machinery” in Pakistan was effectively controlled.
Speaking to journalists on his way back from a week-long visit to Africa, Dr. Singh said that even though the Headley trial had not brought out anything new, his government would study the proceedings once it was over. But he gave no indication that a rethink of the current dialogue-based policy towards Pakistan was on the cards. “It goes without saying that we must use every possible opportunity to talk to Pakistan and convince them that terror as an instrument of state policy is simply not acceptable to people in the civilised world as a whole. And as Pakistan's neighbour, we have great worries about the terror machine that is still intact [there].”

02) The only difference is, now at Chicago Trail of Rana, one eye witness and the evidences produced by the prosecution together are telling the world the story of decades in a few weeks time!

Chicago, May 24: Pakistan's spy agency ISI helped terror group Lashkar-e-Taiba to execute the Mumbai terror attacks, David Coleman Headley, a key 26/11 accused who pleaded guilty to laying the groundwork for the 2008 strikes, told a court here today (May 24).

The testimony by 50-year-old Headley, a prosecution witness, came as the trial of Mumbai attacks co-accused and his longtime friend Tahawwur Rana, a Canadian of Pakistani origin, opened in the US at Chicago's Dirksen Federal Building. Pakistani-American Headley is also a co-accused.

Headley had scouted India's key atomic installation BARC and had visited Shiv Sena headquarters in Mumbai, said prosecutor Sarah Streicker told Judge Harry D Leinenweber. Headley had gone to Shiv Sena office to build contacts with its public relations officer Rajaram Rege.

This fact we in India knew all the while.  This trial would give credence to the dozens of dossiers handed over to the Pakistani Authorities by the Indian Authorities.

The trial of Pakistani-Canadian Tahawwur Hussain Rana who is accused with David Coleman Headley for the 2008 Mumbai terror attacks began here on Tuesday.

Rana, a 50-year-old Chicago businessman, is accused of helping his childhood friend, Headley, to scout targets for the militant group Lashkar-e-Taiba (LeT) for the Mumbai attack that killed 166 people, including six Americans. The trial began with the jury selection process at the Dirksen Federal Courthouse.

A total of 100 jurors filled out the questionnaire and will be questioned by US District Court Judge Harry Leinenweber on Wednesday in what is supposedly the most important terrorism trial ever to be held here. After the jury is finalized this week, the opening arguments of the case will be presented by both sides.

Rana with his gray beard and hair and wearing spectacles was accompanied with his attorneys Patrick Blegen and Charlie Swift. "It is the beginning of jury selection and jurors are filling out the questionnaire even as we speak," Blegen told reporters here.

The conviction of Rana automatically proved the guilt of Pakistan ISI's Training, Arming and exporting Terror to India.
