The moment it is established that there was no loss to the state exchequer, the whole case of cheating and conspiracy in the spectrum allocation will go, the former Telecom Minister said.

Jailed former Telecom Minister A Raja today told a Delhi court that he would get Prime Minister Manmohan Singh, then Finance Minister P. Chidambaram and present Telecom Minister Kapil Sibal summoned as witnesses to prove government did not incur any loss in the 2G allocation.

“Aaj main bata dena chahta hu ki main Prime Minister, tabke Finance Minister or vartman ke Telecom Minister ko battor gawah banaunga (Today, I want to state that I would get the Prime Minister, the then Finance Minister and the present Telecom Minister summoned as witnesses),” Senior Advocate Sushil Kumar, appearing for Mr. Raja, told Special CBI Judge O.P. Saini.

The moment it is established that there was no loss to the state exchequer, the whole case of cheating and conspiracy in the spectrum allocation will go, he said, claiming that the Prime Minister and two other ministers would be able to establish that.

A Delhi court on Wednesday cut-short hearing in the 2G spectrum case to facilitate the Income Tax department to begin its three-day interrogation of former Telecom Minister A. Raja and five other co-accused.
Mr. Raja, Swan Telecom Promoters Shahid Usman Balwa and Vinod Goenka and three top Reliance ADAG officials — Gautam Doshi, Hari Nair and Surender Pipara — were allowed to be quizzed in judicial custody by the I-T department.
Special CBI Judge O. P. Saini on July 21 had allowed the three separate applications of the department for quizzing Mr. Raja in connection with his family income.

New Delhi:  With all guns blazing, A Raja took clear aim today in court at the Prime Minister, P Chidambaram, Ratan Tata, and Attorney General GE Vahanvati. Mr Raja was defending the charges against him in the telecom scam, which he is accused of spawning when he was Telecom Minister.

First, Mr Raja sought to make good by stating,  "I did not seek to implicate the Prime Minister and the then Finance Minister in the 2G case." He also blamed the media for "putting words in my mouth" and declared "I am not after anybody."Through the course of the day, he again placed the PM squarely in his line of defense, and said that Mr Chidambaram should be made a witness in the trial. 

Mr Raja's position is clear: if he is guilty of violating the country's telecom policy, others who could have prevented him failed to do so.   Mr Raja was Telecom Minister till November when he resigned over charges of corruption and the 2G scam. He was arrested in February and has been in Tihar Jail since.

For example, he said that if the Prime Minister wanted, he could have set up a Group of Ministers (GoM)  to supervise the manner in which Mr Raja sold licenses in 2008 for mobile networks and the airwaves they use.  Mr Raja has been accused of selling those licenses at bizarrely low rates, to companies who were not eligible for them but benefited from Mr Raja's patronage. "The Prime Minister is superior to me and he could have constituted the GoM," Mr Raja said.  

In late 2007, Mr Raja over-ruled the recommendations of the Law Ministry that a Group of Ministers be consulted on the pricing and distribution of spectrum.  Mr Raja told the PM this was not necessary.  Mr Chidambaram was Finance Minister at the time.

As he is going down, he appear to be determinant to tarnish the images of as many big fish as possible!

Whatever, even if the complicity of some of them whom he accuses to be the co-conspirators, is proven, his own guild doesn't get diminished nor his punishment would be reduced!!

Further, so far his line of argument is that he was only following what all of his predecessors were doing but hasn't denied that he hasn't, illegally, gained anything out of spectrum allocation racket!!!

Telecom Minister Kapil Sibal today hit out at Opposition BJP for demanding the resignation of Prime Minister Manmohan Singh and Home Minister P. Chidambaram by treating the argument of former telecom minister A. Raja in 2G scam case in the court as evidence against the government.


His comments came after BJP president Nitin Gadkari demanded resignation of Singh and Chidambaram stating that what Raja had said in court showed that the top leadership of the government was aware of all 2G transactions.
Raja told a Delhi court hearing the 2G case that Chidambaram, then Finance Minister, had told the Prime Minister that dilution of shares by 2G licencees to attract FDI did not not amount to sale of licence.
Sibal told a press conference it was 'unfortunate' that President of a national political party like BJP demanded resignation on the basis of arguments made by Raja in the court.
"He (Gadkari) should have consulted Arun Jaitley (senior BJP leader) or some other lawyer".

True, what applies to BJP, also applies to Congress; till the allegations are substantiated with irrefutable proof, it cannot become an evidence for Courts!

Former Telecom Minister A.Raja today questioned his prosecution in the 2G spectrum scam by telling a Delhi court that entire proceedings were 'vitiated' as the probe relating to him was incomplete.
"As on today, this trial is vitiated because while the trial is commencing, investigation is pending in the same RC (CBI FIR)," he contended before Special CBI judge O.P. Saini while accusing CBI of being 'dishonest' in its probe.
He alleged CBI was unfair to him as he was quizzed on July 18 in connection with the allotment of licence to Loop Telecom, alleged to be the front company of Essar Group, despite the agency informing the court on July 14 that investigations against him with regard to the two chargesheets was complete.
"Why is CBI not completing the investigation? How can you (the court) send me (Raja) to be interrogated on July 18 after you (the court) in your order dated July 14 had said that probe on Raja is complete?," senior advocate Sushil Kuakr said.
Questioning the court's order permitting CBI to quiz Raja on July 18, he said, 'how can CBI be allowed to question him (Raja) regarding Loop Telecom (one of the companies allotted 2G licences)"?
He accused CBI of giving 'misleading statement' and said the trial should be fair.
"CBI is dishonest with the court. They took my (Raja's) custody for (questioning) Loop Telecom after making a statement before the court that the probe with respect to me is completed," he said.

Well, as they say, "Offence is the Best form of Defence", which Raja is implementing;

And insinuating the others knowing his murky transaction doesn't make his crime any less!

If others are involved, they too would be prosecuted but it doesn't mean Raja would be let off lightly!!

Former Telecom Minister A. Raja, arrested for his role in the 2G scam, will begin his arguments on charges of cheating, forgery and criminal conspiracy against him from Monday.
With the CBI completing its arguments on framing of charges against Raja and 16 others, including 3 telecom firms, the former minister will begin his arguments from July 25.
"Arguments on charge for prosecution heard and concluded. Put up for arguments on charge for the accused persons on July 25, 2011," Special CBI Judge O P Saini said.
While concluding his arguments, Special Public Prosecutor U.U. Lalit told the court that going purely by the note on revision of licence fee by Indian Revenue Service officer Manju Madhavan or the Prime Minister's letter, a loss of Rs 30,000 crore has been caused to the public exchequer.
Lalit said besides Raja, others involved in the scam that caused huge loss to the exchequer, included former Telecom Secretary Siddhartha Behura, Raja's erstwhile aide R.K. Chandolia and corporate honchos Shahid Balwa, Vinod Goenka and Sanjay Chandra.

The Central Bureau of Investigation on Thursday told a Delhi court that former Telecom Minister A. Raja had approved the grant of dual technology 2G spectrum licences to his favourite telecom firms like ADAG’s Reliance Communication and others a day before inviting applications for it.

Opening his arguments on framing of charges before Special Judge O.P. Saini, Special Public Prosecutor U.U. Lalit said Mr. Raja had given in-principle approval for grant of 2G licences to Reliance, HFCL and Shyam Tele link on September 18, 2007, a day before his ministry officially opened the scheme on September 19, 2007, for grant of these licences.

A day later as Tata Teleservices applied for the 2G spectrum licence on September 19, the Telecom Minstry deliberately sat over its plea, he added.

2G Spectrum Scam: Raja, Behura, Doshi questioned on Loop-Essar nexus!!

New Delhi:  Former Telecom Minister A Raja, accused in the 2G scam case, was questioned by the CBI for three hours today at the Patiala House lock-up. The investigating agency also questioned former telecom secretary Siddharth Behura and Anil Dhirubhai Ambani Group's Gautam Doshi.

The CBI said it wanted to question the trio before it filing its next supplementary chargesheet in the 2G spectrum scam. 

Sources say the entire questioning was focused on the Loop-Essar nexus. 

Sources also say that the CBI in its third chargesheet will mainly focus on these companies. The investigation agency believes Loop was a front for Essar and is now trying to gather all possible evidence to corroborate that. 

The reason Mr Doshi was questioned along with Mr Raja and Mr Behura is because the CBI wanted to know if he was aware of other telecom companies like Loop devising strategies to circumvent the rules and whether Raja and his men helped them in the process, sources add.

A Delhi court on Saturday allowed the Central Bureau of Investigation (CBI) to again interrogate former communications minister Andimuthu Raja and two other accused, who are in judicial custody, in the 2G scam case.
Special CBI Judge O.P. Saini allowed the probe agency to question Raja, former telecom secretary Siddhartha Behura, and Gautam Doshi, a telecom company's official.
"The CBI is allowed to interrogate the three accused on Monday," the court said while pronouncing the order.

The accused in 2G spectrum scam on Thursday charged the Central Bureau of Investigation in a court in New Delhi with delaying the proceedings for framing of charges for frustrating their chance of securing bail.
The accused, including former Telecom Minister A. Raja, Dravida Munnetra Kazhagam MP Kanimozhi and top corporate honchos, alleged that the CBI was filing additional documents to delay the proceedings required for starting arguments on framing of charges for which the special court has already asked the parties to complete the scrutiny of documents expeditiously.
The advocates for the accused raised objections to the CBI’s move and the proceedings in the 2G case witnessed for the first time, trading of charges between the accused and prosecutors.
The agency, the accused said, has not only “concealed the documents” and “wilfully abstained” from filing them with their charge sheets but “they (CBI) are not prepared to go for the trial because they have not completed their investigation”.
“Even in the Supreme Court, they have said that they are going to file another charge sheet. How do I know if it has anything against these 17 accused,” advocate Vijay Agarwal, appearing for Swan Telecom promoter Shahid Usman Blawa, submitted before Special CBI judge O.P. Saini.

New Delhi:  The Prime Minister's Office today said it will provide to an RTI applicant the correspondence between Prime Minister Manmohan Singh and former Telecom Minister A Raja in connection with 2G spectrum allocation.
     
The PMO said it had not denied any information in this regard to the RTI applicant as claimed by him but the appropriate material could not be given because "the actual request made was not" in the letters between Singh and Raja.
     
The RTI applicant had sought to know why Raja was kept in the Cabinet despite serious allegations of corruption against him. He claimed that PMO had denied this information, saying it does not have any record related to the allegations of corruption against Raja.

Former telecom minister A. Raja and his staff threatened and coerced officials in giving preference to Swan Telecom and Unitech over Tata group in the award of telecom licences, CBI has informed the Joint Parliamentary Committee probing the 2G scam.
Director CBI A.P. Singh who gave a detailed presentation on various aspects of spectrum allocation scam on June 7 told the panel that two officers who did not put the file, giving preference to Swan Telecom over Tata Tele-Services Limited, were transferred by Secretary (Telecom) Siddarth Behura “in league with” Raja’s private secretary R.K. Chandolia.
He told the JPC that the then Wireless Advisor R.P. Aggarwal was given “credible threat of consequences” and was forced to put up a note for allocating spectrum to Swan in Delhi circle, which was approved by Mr. Behura and Mr. Raja.
Were Sr. Telecom Officials were so recourseless against such threat that they, invariably, had to comply the corrupt Minister and become part of that National Loot of 176,000 Crores, willy, nilly?
The relationship between Ambani-headed company, Reliance Telecom and Swan Telecom, aren't intriguing, as this is how they they bend the rules!

2-G Spectrum Scam CBI Case: Kanimozhi, Raja appear in court!

Dravida Munnetra Kazhagam (DMK) lawmaker Kanimozhi and former Telecom Minister A Raja were on Saturday produced before a special court here in connection with the 2G spectrum scam. Kanimozhi's mother and DMK leader T R Baalu were also present in the court. A special CBI court had on Friday refused to grant bail to Kanimozhi and Kalaignar TV managing director Sharad Kumar citing the ‘magnitude of the crime’.

While Kanimozhi was lodged in Jail No 6, Kumar was sent to Jail No 4, which also has Commonwealth Games scam accused Suresh Kalmadi.

The CBI had claimed that Kanimozhi lobbied for A Raja to become a Union Cabinet minister.

But they are only small fish, whose sleaze money isn't crossing Rs. 1,000/- Crores;  what happened to the 'Big Fish' ("Where is all the sleaze money of atleast Rs. 35, 200 to Rs. 33, 600/- of 2-G Spectrum gone???" at, http://prmadhura3.blogspot.com/2011/05/where-all-sleaze-money-of-atleast-rs-35.html
