President rejects mercy plea of Rajiv’s assassins

New Delhi: President Pratibha Patil has rejected the clemency petitions of three killers of Rajiv Gandhi whose death sentences were confirmed by the Supreme Court in 2000.

The apex court had sentenced members of the banned Liberation Tigers of Tamil Elam (LTTE) Murugan, Santhan, Perarivalan and Nalini to death in 1999 for the assassination of the former prime minister in Sriperumbudur on May 21, 1991.

A Rasthrapati Bhavan spokesperson said the clemency petitions of all three accused were turned down by the President last week.

The apex court had confirmed the death sentence of Murugan, Santhan and Perarivalan while commuting Nalini's sentence to life imprisonment.
The trio, charged with criminal conspiracy and execution of the suicide attack plot, had filed mercy petition before the President after confirmation of sentence by the apex court.

New Delhi:  Former Central Vigilance Commissioner (CVC) PJ Thomas has appealed to President Pratibha Patil to wait for the outcome of his plea in court before the new CVC is appointed. In March this year, the Supreme Court declared that appointment of Thomas as India's CVC was invalid. 

Yesterday, Thomas filed a writ petition in Delhi High Court saying new the CVC should be appointed only after a decision is taken on his March application.

"The SC judgement was delivered by a three-judge bench whereas it should have been a five-judge bench. Then the legality and validity of this judgement itself is disputed," Will Mathews, Counsel for PJ Thomas, told NDTV. He added that the new CVC should be appointed "only when the legality and validity of this judgement is verified."

The rejection of the mercy pleas of Devinder Pal Singh and Mahendra Nath Das by President Pratibha Patil on Thursday seems to have reminded the BJP of an issue it seemed to have forgotten. The party returned to the earlier rhetoric, demanding that the mercy plea of Parliament attack accused Afzal Guru be rejected.

Guru's petition was first rejected by the Supreme Court on August 4, 2005. The second petition was rejected on May 14, 2008. “If terrorist Afzal Guru had managed to enter Parliament [on September 13, 2001], the entire political leadership would have been killed,” said BJP spokesperson Ravi Shankar Prasad. “Doesn't deliberate, conscious delay of decision on Afzal Guru amount to destruction of the secular fabric [of the country]?” he asked, connecting the issue to Clause 3 of the Communal Violence Bill.

Issues of this nature should not be politicised.  Delaying decisions amount to delaying justice, willfully.  As Afzal Guru has waged against India and almost succeeded in eliminating our Political Leaders in Parliament, he should be hanged, without any considerations.

Presidential pardons should be given to those who have done a crime of passion but not those who schemed against nation.
