As New York prosecutors neared a decision to drop charges against Dominique Strauss-Kahn, their relationship with the alleged victim devolved sharply. John Solomon gets an exclusive look at their letters.

In the final days before they decided whether to drop sexual-assault charges against Dominique Strauss-Kahn, New York City prosecutors and lawyers for the accuser engaged in an unusual exchange of letters that laid bare just how far their relationship deteriorated during the headline-grabbing case, The Daily Beast has learned.

Hotel maid Nafissatou Diallo, who accused the powerful Frenchman of attacking her May 14 when she went to clean his luxury suite, was treated by prosecutors more like a defendant than a victim and in a manner that would deter other sexual-assault victims from coming forward, her lawyer Kenneth Thompson wrote in a biting Aug. 8 letter to the Manhattan district attorney’s office that was obtained by the Beast.

    

“Through the use of intimidation tactics, unscrupulous and false leaks to the media and public attacks on the victim and her attorneys, your office has managed to turn back the clock to a time in which victims of sexual crimes rarely came forward for fear of exactly what has happened to Ms. Diallo in this case,” Thompson wrote.

Thompson’s broadside came three days after the prosecutors took the rare step of seeking attorney-client privileged communications outlining any effort the hotel maid’s legal team made to seek a civil settlement with Strauss-Kahn as the criminal case was still proceeding.

  

The exchange of letters was the final act in the surreal evolution of a sexual-assault case that landed Strauss-Kahn in jail for days, stripped him of his prestigious job as chief of the International Monetary Fund, and tarnished his chances of running for the French presidency, before falling apart.

Prosecutors are likely to argue in their court filing Tuesday that while there is no doubt a sexual encounter took place in the hotel room, they no longer believe they can prove beyond a reasonable doubt whether it was consensual or forced because of widespread credibility problems with the alleged victim that emerged in the weeks after the charges were filed.

Nafissatou Diallo’s attorneys depict a scene of physical confrontation and sexual violence characterized by even more ‘depravity’ than previously described.

In a ferocious assault on the personal character, professional arrogance, and sexual predilections of former International Monetary Fund Managing Director Dominique Strauss-Kahn, lawyers for the hotel chambermaid who has accused him of attempted rape and criminal sexual assault filed a civil suit in New York today.

Strauss-Kahn has denied all criminal charges lodged against him, and still stands a good chance of having them dropped by Manhattan District Attorney Cyrus Vance Jr. But in their complaint on behalf of Nafissatou Diallo, a 32-year-old illiterate African immigrant employed by the Manhattan Sofitel hotel, attorneys Kenneth Thompson and Douglas Wigdor depict a scene of physical confrontation and forced oral sex characterized by more “sheer depravity,” to use their words, than previously described.

Strauss-Kahn will have at least 20 days to respond to the civil complaint from the time he is served with the papers. As of 5:30 p.m. Monday, that had not happened. He is due for a new hearing on the criminal charges on August 23.

If the rhetoric of Diallo’s attorneys could condemn, then Strauss-Kahn would be headed straight for perdition—or at least massive payments, whether settled before a jury or out of court. The burden of proof in a civil case is much lower than in a criminal case, which requires that guilt be established “beyond a reasonable doubt.” But the tenuousness of the criminal case against Strauss-Kahn (or DSK, as he’s widely known) stems from doubts about the plaintiff’s past and her history of lying on official documents, including a fictionalized claim of rape on her asylum application. How those will play in a civil court remains an open question, and Thompson and Wigdor have been fighting a high-profile battle to keep the criminal case engaged even as they prepared the civil suit.

(Reuters) - Lawyers for the New York hotel maid who says Dominique Strauss-Kahn tried to rape her are looking to talk to Air France staff about the once globetrotting chief of the International Monetary Fund.

Hotel maid Nafissatou Diallo's lawyers are fighting to keep a criminal case against Strauss-Kahn going after New York prosecutors said doubts had arisen over her credibility.

"I received an anonymous letter from someone who apparently works at Air France about Dominique Strauss-Kahn, and we're now looking to talk to Air France employees," Diallo lawyer Kenneth Thompson told Reuters by email.

An Air France spokeswoman would not confirm whether the company had been contacted by Diallo's legal team or say whether the airline was aware of any complaints by flight attendants.

Strauss-Kahn, 62, spent much of his life on planes in his job as IMF head and travelled regularly on Air France (AIRF.PA).

Despite leaks to the contrary, a lawyer for Dominique Strauss-Kahn’s accuser says a recording of her conversation with a friend after the alleged attack does not show she schemed to make money.

The lawyer for the hotel maid who has accused Dominique Strauss-Kahn of sexual assault tells The Daily Beast that tape recordings in the possession of prosecutors capture her describing her alleged attack to an incarcerated friend less than 24 hours after it occurred in a manner consistent with what she told police and prosecutors.

The tapes also show a much different conversation about lawyers and money than what was leaked by authorities earlier this month in a newspaper report, attorney Kenneth Thompson said late Wednesday night after listening to the audio recordings for the first time.

Thompson and the maid, Nafissatou Diallo, 32, met Wednesday with the New York District Attorney’s Office for the first time in nearly a month after the relationship between the alleged victim and prosecutors fell apart over questions about her credibility.

The meeting came just days after Diallo described the attack in an exclusive interview with NEWSWEEK.

Strauss-Kahn was the head of the International Monetary Fund and a leading candidate for French president before Diallo accused him of attacking her and forcing her to have oral sex after she entered his luxury suite to clean it May 14 at the Sofitel Hotel in Manhattan.

After being arrested, Strauss-Kahn resigned his IMF post and has pleaded not guilty to sexual assault and attempted rape in a case that has fascinated two continents and taken several dramatic turns.

(Reuters) - After more than two months in seclusion and anonymity, the hotel maid who accused Dominique Strauss-Kahn of sexually assaulting her is telling her story and hoping for success in the court of public opinion.

But legal experts say talking to the media at this point is a risky tactic that could weaken the prosecution's case against Strauss-Kahn and reduce the woman's chances of winning a civil suit, which her lawyers said she intends to file shortly.

"I think the decision to come forward is a desperate gambit to try to put pressure on the prosecution to consider not dropping the case," said Alan Dershowitz, a well-known criminal-defense attorney.

Dershowitz said that while this move could ultimately succeed, "it's a high-risk tactic, obviously devised by her lawyer, who may see a pot of gold at the end of the rainbow."

Originally cast as a victim with a steadfast story, Nafissatou Diallo's credibility was called into serious doubt after prosecutors alleged she lied on her asylum application and gave varying accounts of her actions after the May 14 encounter at the Sofitel hotel in Manhattan.

Kenneth Thompson, one of Diallo's attorneys, insists the purpose of the media offensive is to counter her negative and inaccurate portrayal in the media.

"Ms. Diallo came forward to clear her name," he said. "She is not a prostitute or a hooker or a con artist trying to shake down DSK. ... She is the victim of a brutal sexual assault."

RISKS OF SPEAKING OUT

In an interview with Newsweek -- part of a well-orchestrated media blitz one week before Strauss-Kahn's next court date -- Diallo, 32, said of Strauss-Kahn: "I want him to go to jail. I want him to know there are some places you cannot use your power, you cannot use your money."
