Gandhinagar: In an unprecedented move, the Gujarat Governor has appointed Retd. Justice RA Mehta as Lokayukta of the state, bypassing the Narendra Modi-led BJP government which had kept the post vacant for the last seven years.

Gujarat Opposition Leader Shaktisinh Gohil, who had led a delegation of Congress MLAs to the Governor on the issue of Lokayukta, said, "Gujarat Governor Kamla has appointed Retd Justice RA Mehta as Lokayukta late last night."

The name of Justice Mehta was suggested by Chief Justice of Gujarat High Court SJ Mukhopadhaya to the state government, but it had not made the appointment till now, he said.

The move by the Governor of bypassing state government in appointment of Lokayukta was taken by her after "thorough consultation with legal experts," Gohil said.

"Governor has told us that non-appointment of Lokayukta for the last seven years, was a matter of grave concern as there was no authority to look into affairs of the government," he said.

In fresh trouble for former Chief Minister B.S. Yeddyurappa, the special Lokayukta court today issued summons to him and 14 others to appear before it on August 27 in connection with a private complaint against them alleging denotification of lands favouring his family members.

Pronouncing the order on the second complaint by advocate Sirajin Basha, Judge Sudhindra Rao said Yeddyurappa and others have been directed to appear on August 27.

In the complaint, Basha has alleged that Yeddyurappa denotified 2.5 acres in Arakere village, 1.7 acres in Devarachikkanahalli in Bangalore South taluk and 1.21 acres in Gedalahalli village in Bangalore East taluk violating rules.

Rejecting the allegations levelled against JSW Steel in the Karnataka Lokayukta report, the Sajjan Jindal-led firm on Thursday said it was “appalled and concerned with the untenable conclusions” drawn in the report.

Giving its rebuttal on allegations of seeking favours to get iron ore mining leases and other illegal actions made in the report, the company claimed itself as an aggrieved party that had not been allotted a single captive mine despite being the biggest investor in the State.

“However, it is not looking at taking legal recourse for now but it may do so in future, JSW Steel's Joint Managing Director M.V.S. Seshagiri Rao told journalists here.

He, however, evaded direct answers to questions on his firm's transactions with former Chief Minister B.S. Yeddyurappa's sons, son-in-law and other family members.

When asked about the accusations of paying excess money to former Mr. Yeddyurappa's sons for buying an acre of land, eventually which triggered resignation of the BJP leader, Mr. Rao claimed that the company paid market price and was willing to make its sale deed agreement public.

Karnataka Lokayukta Shivaraj Patil said the anti-corruption body needed more powers. He assured that the good work of his predecessor would be carried forward.

Former Supreme Court Judge, Shivaraj V. Patil today took over as Karnataka Lokayukta and said corruption would not be tolerated at any level in the state.

Addressing his maiden press meet after being sworn-in by Governor H.R. Bhardwaj, he said, “let the message go that corruption will not be tolerated at any level in the state. Stringent action will be taken against those who indulge in it (corruption).”

Asserting that pressure of any kind shall not work, Mr. Patil, who succeeds Santosh Hegde whose term ended yesterday, warned that if some people indulged in exerting pressure, “they will regret”.

Earlier, Mr. Patil had probed the procedures followed in allocation of telecom spectrum in 2001-09 following the 2G spectrum scandal.

Mr. Patil said the oath he had undertaken would be his “guiding spirit” and he would stand by it.

Though the oath is “tough and challenging as expectations are high, I will make endeavours to see that culprits are brought to book at the earliest. The good work done by the previous Lokayukta will be carried forward and we will add to it,” Mr. Patil said.

Responding to a query on the report on illegal mining submitted by Mr. Hegde (which indicted outgoing Chief Minister B.S. Yeddyurappa), Mr. Patil said, “the report submitted by Lokayukta is long and stupendous. I have not yet read the report, unless I study the report in detail, I cannot comment on it”.

To another question on Governor according sanction to Lokayukta police to initiate criminal proceedings against Mr. Yeddyurappa over the report on illegal mining, Mr. Patil said, “the communique sent by the Governor, has not yet been placed before me, once it is placed. I will examine it and take appropriate action as per the Lokayukta Act”.

Bangalore:  Former Supreme Court judge, Justice Shivaraj V Patil was today appointed the new Lokayukta of Karnataka.  He will take over from N Santosh Hegde, who welcomed Mr Patil's appointment as a "very good choice".
      
After the 2G telecom scam crowbarred its way into the country's headlines, Mr Patil served as a one-man committee appointed to study the processes and procedures followed by the Department of Telecommunications in distributing licences and spectrum between 2001 and 2009.

Mr Patil is 71. He takes over as Lokayukta at a time when Karnataka is caught in the middle of a political crisis. Mr Hegde's report on illegal mining has inducted politicians from all major parties, including the Chief Minister, BS Yeddyurappa.  Mr Hegde's term expires on August 2.

BANGALORE: Even as the second report on mining by Lokayukta Justice N Santosh Hegde is expected around July 25, the latter's disclosure that some influential BJP leaders tried to influence him on the report has put the state government in a bind. 

On Saturday, an embarrassed BJP spokeperson C T Ravi queried on the matter after the party's state executive committee meeting in Hubli said: "Why is the Lokayukta reacting now?" 

Speaking to STOI on Saturday, Justice Hegde said: "Nobody can afford to buy me." According to him, Karnataka's special representative in New Delhi V Dhananjay Kumar, Third Finance Commission Recommendations Implementation Task Force chairman A G Kudagi and a senior minister had come to invite him for a function in Udupi some months ago. Later, Dhananjay Kumar is said to have spread the word around that Justice Hegde had been "fixed and adjusted" on the mining report. 

Justice Hegde said Dhananjay Kumar tried to contact him after that, but he did not entertain him.

• Ending months of uncertainty, President Pratibha Patil has rejected the city Lokayukta's recommendation to sack Delhi PWD Minister Raj Kumar Chauhan for his alleged involvement in protecting a leading resort in a tax evasion case.
  The Home Ministry on Wednesday conveyed decision of the President through a letter to Lokayukta Justice Manmohan Sarin who indicated his deep disappointment over rejection of his recommendation, saying such reverses are expected when moral values are sought to be enforced.
  "The President has not accepted the findings and recommendations made by the Lokayukta against Chauhan," the Home Ministry said in the letter.
  With due respect the office of the President of India, I strongly feel that barring granting of clemency to the convicts, whose death sentence are confirmed by the Supreme Court, all other 'powers to pardon' from the President must be revoked, through a constitutional amendment.
  Otherwise, the party in power would always recommend their cronies to be excused and the President wouldn't have any choice than to oblige.
  At this rate of exonerations, 1 million Lokpals will not be able to do any good to the country!
