Death row trio says 11-year delay is inhuman; eight weeks for Centre to reply.

The three condemned prisoners in the Rajiv Gandhi assassination case got a reprieve on Tuesday, with the Madras High Court staying their execution, due to be carried out on September 9.

A Division Bench, comprising Justices C. Nagappan and M. Sathyanarayanan, passed the interim order on petitions by Perarivalan, Santhan and Murugan. As the matter involved the consideration of a question of law, the petitions were being admitted and there would be an interim injunction, the Bench said.

Additional Solicitor-General M. Ravindran and Advocate-General A. Navaneethakrishnan took notice for the Central and State governments. The Bench said the counter should be filed in eight weeks.

As soon as the order was dictated in the court hall, there were joyous shouts inside and outside.

Slogans were raised on the court premises. Crackers were burst in front of the court.

The petitioners' main contention was that the delay in disposal of the mercy petitions by 11 years and four months made the execution of the death sentence “unduly harsh and excessive,” amounting to violation of their right to life under Article 21 of the Constitution. The sentence of death after 20 years of incarceration was “unjust and inhuman.”

The Madras High Court will hear on Tuesday the review petitions of the three death row convicts in the Rajiv Gandhi assassination case, seeking an interim injunction to stay their execution.
Their mercy petitions were rejected by the President and September 9 has been fixed for their hanging.
Santhan, Murugan and Perarivalan have sought to set aside the August 12 order of the President, rejecting their mercy pleas and commute their death sentences to life on the ground of ‘undue delay’ in disposing of their mercy petitions.
Advocate N. Chandrasekaran made a mention in the court of Justice N. Paul Vasanthakumar on Monday morning, seeking an early hearing of the petitions, following which the Judge agreed to hear them on Tuesday.
In three separate petitions, the convicts also sought an interim injunction to stay their executions till disposal of their petitions.
They contended that their mercy pleas were with the President for 11 long years since April 26, 2000 before being rejected. They claimed ‘an unwarranted, illegal and unconstitutional delay is caused by the President and the Union of India in the disposal of the mercy petition.’ “No explanation has been offered either for the delay in forwarding of the mercy petitions by the state government to the President or the delay in disposal by both the authorities,” they contended.
They said they had sent fresh mercy petitions to the President on August 27.

A USC scientist has created a virus that hunts down HIV-infected cells, which could herald a breakthrough toward curing the disease.
Dr. Pin Wang’s lentiviral vector latches onto HIV-infected cells, flagging them with what is called “suicide gene therapy” — allowing drugs to later target and destroy them.
“If you deplete all of the HIV-infected cells, you can at least partially solve the problem,” said Wang, chemical engineering professor with the USC Viterbi School of Engineering.

BATHTUB KILLER: Japanese man gets life for murder of British woman!

A 32-year-old Japanese man was on Thursday sentenced to life imprisonment for raping and killing British teacher Lindsay Ann Hawker in 2007, before burying her battered body in a sand-filled bathtub.
Tatsuya Ichihashi - who spent more than two-and-a-half years on the run after the 2007 crime and had plastic surgery to evade capture - had admitted raping his English teacher but said he killed her accidentally.
Prosecutors had demanded life for Ichihashi, condemning his crime as 'coarse and extremely self-centered'.
As the presiding judge read out the ruling, a motionless Ichihashi stared at the ground, NTV reported.
Hawker's family - her father, mother and two sisters visiting Japan to hear the verdict - repeatedly wiped tears and nodded many times in approval as the sentence was read out, it said.
Hawker's father Bill had earlier urged the Chiba district court to show 'no mercy' and called for the death penalty - a punishment usually reserved for cases of multiple homicide.
Hawker's parents were also present at Ichihashi's trial, which took place between July 4 and 12, and gave testimony.

A 17-year-old Florida boy has been accused of killing his parents with a hammer, then hosting dozens of friends for a party while their bodies lay in the bedroom.
According to Police, Tyler Hadley used a 22-inch framing hammer to kill his parents, Mary Jo Hadley and Blake Maurice Hadley, then covered up their bodies and drank beer with his friends.
Tyler has been charged with first-degree murder, ABC News reports.

KANDAHAR, Afghanistan — The man who murdered President Hamid Karzai’s half brother spent years as an ally of the United States in the war against the Taliban.
The killer, Sardar Mohammad, a police commander, met on several occasions with U.S. and British military officials, shared intelligence with Americans and played a part in Afghan arrests of scores of Taliban fighters, according to three relatives interviewed on Thursday in his home near Kandahar.
The reasons behind the dramatic switch that turned the 35-year-old officer against Ahmed Wali Karzai, perhaps the most powerful figure in southern Afghanistan, are still not understood. But one of Karzai’s brothers and a senior Afghan official said they were now convinced that the Taliban somehow won Mohammad’s allegiance in recent months and convinced him to carry out an assassination on the group’s behalf.
The official said that investigators are trying to determine whether Mohammad was a long-term Taliban sleeper agent or just recently joined the insurgents. A NATO spokesman in Afghanistan referred questions about Karzai’s killing to Afghan authorities. 
Mahmood Karzai, one of the president’s brothers, said the family has learned since the assassination that Mohammad traveled to the Pakistani city of Quetta within the past three months to meet with Taliban insurgents. He had also acted erratically in recent weeks, sleeping poorly, changing houses at night, acting suspiciously toward his men and demanding to know who they were talking to on their phones.
