New Delhi: The CBI on Monday told a Delhi court that former Telecom Secretary Siddhartha Behura had 'declared' Swan Telecom an eligible firm for grant of 2G spectrum license.

Behura joined the Department of Telecommunication (DoT) in January 2008 and on January 9, he passed a note that Shahid Usman Balwa-promoted Swan Telecom was a eligible firm for grant of 2G licence, Special Public Prosecutor UU Lalit said.

The prosecutor said there was sufficient evidence against all the accused, including Behura, to proceed with their trial.

"Behura joined DoT in January 2008. His note of January 9 says that Swan Telecom was eligible... He joined the DoT and he could not be held privy to what happened prior to his joining but he held Swan Telecom eligible despite various questions being raised about it within the department. The noting of January 9 was the first manifestation of his involvement," Lalit told Special CBI Judge OP Saini while wrapping up his arguments on framing of charges against all 17 accused.

Lalit rejected the plea of Behura that he cannot be "said to be the a part of the conspiracy" as he joined DoT only days before distribution of LoIs (letter of intents) to firms on January 10, 2008.

Telecom Minister Kapil Sibal today contested the claims of former Telecom Secretary Siddhartha Behura over a December, 2007 meeting held regarding entry fees for 2G licences, in which he had said the then Finance Minister P Chidambaram and former Finance Secretary D Subbarao were present.

"We have looked into records. The records show that there was no such meeting. Neither Chidambaram (now Union Home Minister) nor Subbarao (now RBI Governor) remember any such meeting," Sibal told PTI.

He said, "It is surprising that the then telecom secretary (Behura), who joined (Department of Telecom) on January 1, 2008, is referring to a meeting of December 4, 2007, when he had no personal knowledge of the meeting and has not produced any document to support veracity of his submission."

Opposing the framing of charges of corruption and other penal offences against him in the case, Behura told Special CBI judge O P Saini yesterday that Subbarao had decided against revising the entry fee of Rs 1,659 crore for 2G licences and if he is not an accused in this case, he (Behura) too should not have been put on trial.

"Subbarao finalised the decision taken in the meeting of December 4, 2007, that the policy stood approved and the entry fees (of Rs 1,659 crore fixed in 2001 during NDA's regime) need not be revised," Behura's counsel Aman Lekhi said in the court. Behura has been behind bars for the past six months.

Jailed former Telecom Secretary Siddhartha Behura on Wednesday dragged RBI Governor D Subbarao in the 2G case accusing him of not revising the spectrum licence fee and claimed he had no role to play except implementing the government’s policy.

Opposing the framing of charges of corruption and other penal offences against him in the case, Mr. Behura told the Special CBI judge O.P. Saini that Dr. Subbarao had decided against revising the entry fee of Rs. 1,659 crore for 2G licence and if he is not an accused in this case, he (Behura) too should not have been put on trial.

“Subbarao finalised the decision taken in the meeting of December 4, 2007 that the policy stood approved and the entry fees (of Rs. 1,659 crore fixed in 2001 during NDA’s regime) need not be revised,” Mr. Behura’s counsel Aman Lekhi told the court. Mr. Behura is behind bars for the past six months.

“Even the Finance Minister (then P Chidambaram) was also present in the meeting (held on December 4, 2007). If Subbarao, who was part of the Finance Ministry, did commit no wrong, how come I did it?

Going by the same principle, if I have been made an accused then Subbarao should also be made an accused,” he said.

The former bureaucrat defended himself against the charges against him, saying the acts done by him were in pursuance of the government policy and he did not commit any wrong that caused a loss to the exchequer.

Asserting that there was “not an iota of evidence” against him, Mr. Behura said he was only a civil servant who had no role to play except implementing the government’s policy.

Former telecom secretary Siddhartha Behura, an accused in the 2G spectrum allocation scam, doctored the list of applicants to extend undue benefits to Swan Telecom, the Central Bureau of Investigation (CBI) told the Delhi High Court Thursday.

The court will resume the hearing on the bail application of Behura July 21.

“The role and complicity of Behura in the case is very clear as he legitimized the application of ineligible firm Swan Telecom Private Ltd. and compromised with the seniority list of the applicants to extend undue benefits to it,” the CBI informed Justice Ajit Bharihoke.

The former Telecom Secretary, Siddhartha Behura, was on Monday allowed by the Special Court hearing the 2G spectrum scam case to appear before the Joint Parliamentary Committee for giving oral evidence on July 12.

A letter dated June 25 had been received at the Tihar Central Jail regarding his appearance before the JPC. It was accompanied by photocopies of a letter dated June 17 from the Lok Sabha Secretariat on the matter and another later dated June 24 from Mr. Behura seeking permission to appear before the JPC.

Special Judge O.P. Saini exempted Mr. Behura from personal appearance in court on July 12.

NEW DELHI: The special court hearing the 2G spectrum scam case turned down the bail plea of the former Telecom Secretary, Siddhartha Behura, on Friday. His counsel had submitted that Mr. Behura had no role in deciding the modified first-come first-served policy, cut-off date and dual technology norms and joined the Telecom Department on January 1, 2008, after the decisions were taken.

But Special Judge O. P. Saini, in his order, observed that it was “not necessary in law that a person must remain part of the conspiracy from the beginning to end.”

Senior advocate Aman Lekhi, counsel for Mr. Behura, told the court that this was not a “show trial and the accused must be made to understand the case against him and also the nature and character of evidence on the basis of which he is facing trial.”
