Seeking immediate stay on proceedings against him in 2G-spectrum trial, Swan Telecom promoter Shahid Balwa cited a note by the ministry of corporate affairs (MCA) stating his company is not an associate of Reliance Telecom. The Central Bureau of Investigations had chargesheeted Balwa and his telecom firm, for forging his application in the allocation of 2G-spectrum licenses. The agency alleged it was a face for Reliance telecom, which had already availed the 2G licenses, and it was promoting Swan to get more similar licenses.

Majeed Memon counsel for Balwa said, “As per a news report, the MCA told CBI that Swan Telecom, now Etisalat DB, and Loop Telecom were not associates of Reliance Telecom and Essar respectively."

Balwa’s counsel told the special CBI judge OP Saini that if this is the existing position, then by which standards is CBI asking to frame charges. The trial and framing of charges be stayed forthwith, he said.

NEW DELHI: After Prime Minister Manmohan Singh and Home Minister P Chidambaram, on Monday it was the turn of  Finance Minister Pranab Mukherjee who had held the External Affairs portfolio in the UPA-I Cabinet, to be dragged into the 2G scam in the trial court .

Making a rather startling allegation, 2G accused Shahid Balwa’s lawyer, Majid Memon, claimed that the CBI had withheld from the court some crucial documents pertaining to a personal discussion between Mukherjee, then Minister of External Affairs, and the Solicitor General of those days, Ghoolam Vahanvati, on the telecom allocation policy. This was in 2007.

“There was a personal discussion between the then External Affairs Minister, Pranab Mukherjee and the Solicitor General G E Vahanvati on the allocation policy. The CBI should place all the documents before this court,” Memon argued before Special CBI Judge O P Saini on Monday.

Swan Telecom Promoter Shahid Usman Balwa on Monday demanded in a Delhi court that the CBI 'must answer' as to what is the actual loss suffered by the state exchequer due to the 2G spectrum scam.

Opposing framing of corruption and other penal charges against him, Balwa told Special CBI Judge O P Saini that the agency should have written a letter to the Prime Minister or the Finance Minister to know the actual loss to the exchequer due to the scam.

"The CBI must answer as to what is the actual loss to the state exchequer. It (loss) is the basis of the prosecution and it has to be supported with documentation," advocate Majeed Memon, appearing for Balwa, said.

Memon asserted that the CBI's case is based upon the loss to the state exchequer but the government had stated in Parliament that no loss was suffered and instead the tele-density in the country had increased in 2010 from what it was in 2004.

Memon also asked the CBI if any loss has been suffered by the state exchequer, who exactly was responsible for it and up to what extent.

He also said the probe agency must answer whether Swan Telecom was ineligible to get Unified Access Services (UAS) licence in January 2008.

Balwa's counsel also accused the CBI of adopting selective approach in arresting people in the case.

"It is surprising how out of various companies (which got licences for 22 circles) and persons, the CBI picked up A and B and left others. Why are they adopting the selective approach?," Memon asked, accusing CBI of conducting "a biased, selective and discriminatory approach" in the investigation.

"You (CBI) have just picked up one man of your choice from one point and the other from another point. CBI is blowing up the case so that the court would be hesitant to consider liberty of a person even after months. It is guilty of misleading the court," Balwa's counsel told the court.

UAE based telecom Etisalat on Monday said it is investigating the circumstance under which Shahid Balwa, one of the accused in 2G spectrum issue, persuaded it to invest in Swan Telecom.

"Etisalat is investigating closely both the circumstance in which Mr Balwa persuaded it to invest in Swan (now Etisalat DB) – as a third party foreign investor, brought in after Mr Balwa and Swan had obtained the licenses – and also Mr Balwa's stewardship of the company and its assets," Etisalat said in a statement.

The company said this in reaction to move of Majestic Infracon to Company Law Board against Etisalat and various group companies.

The CBI today opposed the bail plea of Swan telecom promoter Shahid Usman Balwa saying the first-come-first-served (FCFS) policy was manipulated by former Telecom Minister A. Raja and others to such an extent that physically fit persons got away with the 2G licenses.

"Physical fitness of the applicants became the deciding factor in the grant of licenses," Senior advocate and CBI prosecutor U.U. Lalit told Special Judge O.P. Saini.
