The Supreme Court on Tuesday refused to quash some of the charges framed against Sikkim High Court Chief Justice P.D. Dinakaran by a Rajya Sabha-appointed panel looking into allegations of corrupt practices and misconduct against him.

A bench headed by Justice G.S. Singhvi, however, allowed Justice Dinakaran’s plea seeking removal of senior advocate P.P. Rao from the inquiry panel.

The bench asked Rajya Sabha chairman and Vice-President Hamid Ansari to reconstitute the panel by replacing Mr. Rao with another distinguished jurist.

The court, however, made it clear that Justice Dinakaran will be facing the same charges which were framed by the three-member committee comprising Supreme Court judge Justice Aftab Alam, Karnataka High Court Chief Justice J.S. Khehar and senior advocate P.P. Rao.

Rajya Sabha Chairman Hamid Ansari had in January 2010 constituted the three-member panel to examine the 12 charges framed in the notice of motion adopted by the House.

India's Headache: Centre justifies further probe against Justice Dinakaran!

The Centre on Tuesday told the Supreme Court that the Rajya Sabha-appointed panel can carry out further probe and frame definite charges against Sikkim Chief Justice P.D. Dinakaran, who is facing allegations of corrupt practices and misconduct.

Brushing aside protests from Justice Dinkaran’s counsel that the Union Government should not show any interest in the proceedings, Additional Solicitor General P.P. Malhotra said the panel is empowered to go beyond the original charges against the judge.

Quoting section 3 of the Judges Inquiry Act, Mr. Malhotra told a bench of justices G.S. Singhvi and C.K. Prasad, “The information at the time of the notice of motion may be vague. It is a serious matter and you are going into the conduct of the judge. Definite charges can be framed only after collection of further materials and verifying evidence.”

Himself being a legal brain would resort to every trick before he finally subjects himself to Justice.

Supreme Court questions Dinakaran, the Chief Justice accused of Corruption!!

The Supreme Court on Thursday questioned Sikkim High Court Chief Justice P.D. Dinakaran for seeking recusal of one of the members in Rajya Sabha-appointed panel, probing charges of judicial misconduct and corruption against him, 14 months after it was constituted.

“You could have raised the objection in January 2010 when the panel was formed or later. We are not dealing with a person of ordinary mind. He is a legally trained mind,” a vacation bench headed by Justice G. S. Singhvi said.

Justice Dinakaran, 61, pleaded that one of the three members of the committee, senior advocate P.P. Rao, should be recused as he had campaigned against his elevation to the Supreme Court which was later put on hold.

He said there is “reasonable” apprehension of bias against him with the presence of Mr. Rao on the panel.

The artful dodger he is, escaping the investigations, for too long, with his legal knowledge!
