Jayalalithaa is still an accused in Disproportionate Assets Case and being prosecuted in Bangalore Courts!
The Directorate of Vigilance and Anti-Corruption (DVAC), Chennai, has written a “letter” directly to the judge of the Special Court saying that it is continuing with investigation in the disproportionate assets case against Tamil Nadu Chief Minister J. Jayalalithaa.
The “letter”, which is apparently an application filed under Section 173 (8) of the Code of Criminal Procedure (Cr.PC), addressed to the judge of the Special Court and the 36th Additional City Civil and Sessions Court, was delivered directly to the court officer by an Inspector of the DVAC on Wednesday morning without informing the Special Public Prosecutor.
The Special Court has sought a written explanation from the DVAC on why it chose to file the application directly without informing the prosecutor.
“What was the need to give this ‘letter' bypassing the prosecutor? Based on what provision of the law have you written this ‘letter' directly to the court? Normally, whatever the investigating agency will have to submit before the trial court has to be done through the prosecutor,” judge B.M. Mallikarjunaiah asked DVAC Inspector A. Immanuel Gnan Sekhar, who had delivered the application to the court
At this juncture, Special Public Prosecutor B.V. Acharya told the court that the Supreme Court, while transferring the trial to Bangalore from a Chennai court, had condemned a similar type of conduct earlier. He urged the court to seek an explanation from the DVAC why contempt of court proceedings should not be initiated against it.
