Yavatmal: City police on Sunday lodged an FIR against 16 persons, including former Maharashtra Chief Minister Ashok Chavan, state Education minister Rajendra Darda, and MP Vijay Darda, besides other government officials, in connection with an alleged land scam.

The offence has been registered on last week's directive of Judicial Magistrate First Class, Yavatmal KS Kulkarni, based on a petition filed by one Digambar Pajgade, police said.

The complainant had alleged that two plots ad measuring 76,172 sq feet and 59,000 sq feet meant for open space in Darda Nagar Society in the district were illegally occupied by the Jawaharlal Darda Education Society, with the connivance the Wadgaon Gram Panchayat officials, under the influence of the Dardas.

Thereafter, the trust constructed and ran a school and a junior college on the plot.

The complainant claimed that Rajya Sabha member Vijay Darda channelised a sum of Rs 34.53 lakh from his MPLD fund for the construction of the buildings.

After DMK chief M Karunanidhi’s daughter-in-law, it is now his grandson who is feeling the heat of land-grab cases the Tamil Nadu government has initiated against politicians and officials. According to a complaint received by the Chennai police on Monday night, Udayanithi Stalin, who is the son of former deputy chief minister MK Stalin, is the beneficiary of a land grab by a former minister.

The complaint, lodged by a person by the name Ranga Reddy, a trustee of a religious body called Dharma Thopu Trust, accused former DMK minister Parithi Elamvazhuti and his aides of having usurped 7 acres belonging to the trust with the help of “false” documents. The land is worth Rs 200 crore. They then sold the land to a real estate firm owned by a person very close to Udayanithi Stalin. Elamvazhuti was not available for comment.

Earlier there were allegations that Karunanidhi’s daughter-in-law Kanthi Alagiri, wife of union chemicals and fertilisers minister MK Alagiri, grabbed land belonging to a temple in Madurai.

NEW LAND ACQUISITION BILL: Jairam willing to modify land bill based on Trinamool's suggestions!

Kolkata:  After getting the initial nod from West Bengal chief minister Mamata Banerjee yesterday over his draft Land Acquisition Bill, Union Rural Development Minister Jairam Ramesh today said that he is willing to modify the Bill based on her party, the Trinamool Congress' (TMC) suggestions.

Mr Ramesh's statement came after his meeting with Trinamool leader D Bandyopadhay, the man considered to be behind the party's land policy.

After the meeting, the minister said that the main issue with the TMC is the role of the government in the acquisition of land for private players with respect to projects that serve a public purpose.

The current draft of the Bill allows state governments to acquire land for private players if the project in question serves a defined public purpose.

Mr Bandyopadhyay said that the term 'Public Purpose' needs to be strictly defined and that he has provided suggestions running into seven pages to Mr Ramesh.

The minister, on his part, assured Mr Bandyopadhyay of defining the relevant clauses in the Bill.

The developments bode well for the government considering Ms Banerjee has, in the past, opposed the previous versions of the Bill. Not surprising then, that Mr Ramesh chose Ms Banerjee's residence as the first stop yesterday to seek consensus for the crucial and controversial Bill. The chief minister, at the end of the meeting, seemed satisfied with the draft Bill.

Definition of 'Public Purpose' should strictly eliminate any and every form of Private Projects!

The alleged land scam in Bihar involving allotment of prime industrial plots to relatives of ruling NDA politicians and top officials set off fierce political blame games on Wednesday with the Opposition parties MLAs demanding chief minister Nitish Kumar’s resignation and a probe into the land allotments by the CBI.
While the Cabinet ministers and NDA politicians under a cloud for the alleged irregularities denied any wrongdoing, Mr Kumar’s order for a probe by the chief secretary instead of his making an elaborate statement on the allegations in the Assembly was dubbed by the Opposition parties — the RJD, LJP, Congress and the Left parties — as a ploy to eventually bury the scam. The Opposition RJD’s leaders took to Patna’s streets to burn Mr Kumar’s effigies and said they would intensify agitations unless a CBI probe was swiftly ordered.

Against the backdrop of rising protests from farmers over acquisition of their land, the Centre has decided to bring in a new legislation governing the exercise with a focus on farmers’ welfare, Law Minister M. Veerappa Moily said on Saturday.

The Bill, being fine tuned currently, was expected to be introduced in the coming monsoon session of Parliament, he told reporters here.

“The focus of the new legislation would be on protecting the interests of farmers, their welfare and also on sustainable development. We need to balance farmers’ welfare and sustainable development,” Mr. Moily said.

The proposed law would also address issues concerning rehabilitation of farmers after acquisition of their lands.

Government was keen on passing the legislation in the next Parliament session as it cannot afford delay in the wake of conflicts over land acquisition increasing day-by-day, he said when his attention was drawn to Rahul Gandhi’s padayatra in Uttar Pradesh where farmers have been protesting land acquisition by the Mayawati government.


That bill need to address the following:

01) Project activity that takes away the farm lands should create more jobs than it takes away from the Agricultural Sector;

02) Is ecologically responsible in all senses than one;

03) Should make the affected farmers partners in progress of the project.

Taking on the DMK, Tamil Nadu Chief Minister J. Jayalalithaa today said the Special Police Cells set up in each district would go into the charges of land grabbing during the previous regime and take prompt action to return the land to the rightful owners.
"The special cell will go into the complaints of land grabbing during the DMK regime in 2006 to 2011 and take action against those involved under various sections of law," she said in a statement.
Such a move would bring the wrong doers before the law and return the land to the rightful owners, Jayalalithaa said, adding that the AIADMK in its election manifesto had vowed to take strong action against powerful DMK men who were involved in land grabbing.


Will these Special Police Cells also look into the land-grabbing taken place, if any, during the non-DMK government in Tamilnadu?

The Jayalalithaa Government in Tamil Nadu has launched a crackdown on land grabbing with special police cells set up across the state being flooded with complaints.
In the past few weeks, over 550 complaints had been lodged with police after special anti-land grabbing cells were set up in all the districts, police said.
Chief Minister Jayalalithaa during her assembly election campaign made land grabbing a major plank, alleging that powerful DMK men were involved in it and vowed to crush it.
In many instances, complaints have been filed against local DMK functionaries but party Treasurer and former Deputy Chief Minister M K Stalin dismissed them as cases lacking evidence.
"These are all cases filed without any evidence. We will face it," he said recently.
The anti-land grabbing cells were set up on instructions of Additional General General of Police (Law and Order) S George, according to police sources who, however, maintain there was no political overtone to their action.
George said "there were some who used power in various ways for different means but now more and more number of people are approaching the police."
Chennai's suburbs, particularly in adjoining Kancheepuram district, had seen an increase in land grabbing incidence as real estate prices have shot up in the area of late.

Bangalore, Jul 7: State Governor, Hansraj Bhardwaj, gave his nod to Karnataka Lokayukta to file charge sheet against former IT minister, Katta Subrahmanya Naidu, in the Lokayukta court relating a multi-crore land acquisition scam. The Lokayukta wants to prosecute Naidu for his alleged involvement in the land scam involving Karnataka Industrial Area Development Board.


In all likelihood, the Lokayukta will be filing the charge sheet in the court within a week. Lokayukta, Justice N Santosh Hegde, indicated that filing of charge sheet would require a minimum of three days. Once the court begins its hearing, Katta will be required to attend the court proceedings and adduce evidence. If the need be, the Lokayukta may also arrest him. This may also result in embarrassment to the BJP regime, of which Katta is a powerful leader.

BANGALORE: Facing fresh charges of nepotism, Karnataka Chief Minister B S Yeddyurappa on Monday admitted he had allotted residential sites in Mysore to six of his relatives, but indicated it was done on compassionate grounds. 

His admission came after JD(S) alleged yesterday that the Chief Minister alloted sites of Mysore Urban Development Authority to ten of his close relatives under his discretionary quota by "throwing all rules to winds." 

Reacting to the charge, Yeddyurappa said, he had two brothers and they had passed away, while a brother-in-law had died and added that their relatives had been allotted sites. 

However, he pleaded ignorance about four other allotees and said he had asked the Mysore Deputy Commissioner to submit a report in this regard. 

At the height of opposition campaign against him last year, Yeddyurappa's family members, including son B Y Ragavendra, MP, had surrendered prime plots in Bangalore after the allegation of nepotism came under national spotlight. 

What a Papa's compassion for his two multi-millionaire Sons; if he had half that compassion for the 4 Crore poor people voted him to power, by now the 65% of the Kannadigas living below the Poverty line would come down, drastically!!

The West Bengal government on Sunday set the process of formal handover of land to unwilling farmers in Singur in motion by issuing a notice inviting applications for alternative plots of land.
Hooghly DM Sripriya Rangarajan issued the notice which asked unwilling land owners, whose names featured in the schedule prepared by the government in accordance with the Singur Land and Rehabilitation and Development Act, 2011, to apply for alternative plots of equal quantum owned by them inside the project area.
Forms are being distributed at the Singur BDO office by employees of the Block Land Registration Office, the DM said.

HUBLI: The state government has received Expression of Interest (EOI) from companies in Dharwad district which have asked for seven acres of land to install their industry. For this, the government has stepped up to acquire 9,347 acres of fertile land with irrigation facilities.
Karnataka Industrial Area Development Board (KIADB) has started a process to acquire 9,347 acres in 11 villages of Dharwad district where farmers have been growing mango and sugarcane. KIADB special land acquisition officer has issued primary notification for acquiring 5,200 acres while a final notification has been issued for 1,534 acres. A joint survey is under process for acquiring another 2,613 acres.
While the state government is going to acquire land for industrial purposes to attract private industrialists to the region, sources in the KIADB revealed that only a couple of companies have come forward to install their plants in the district. Southern Ferro company of Hubli is seeking for four acres by investing `12.76 crore and Farm Tech Equipments private limited of Dharwad is seeking for three acres by investing `4.81 crore.

Take any Infrastructure Development or Mega Industrial Project in A.P. the story is the same;  to acquire 5 to 20 times more land than is actually required by the project, depriving the livelihoods of the millions of people.

Further, they wouldn't even pay fair market price and also do not implement a proper 'Resettlement and Rehabilitation Packages, as agreed with the government, while obtaining licences.

All this is done with the active connivance and involvement of the corrupt governmental machinery.

It doesn't matter, which political party is in power, the plight of the poor farmers and fisherfolk is the same.

Land acquisition for Posco’s mega steel plant in Orissa’s Jagatsinghpur, which was to have resumed on June 17 and remained stalled, was again put off after the president of a pro-project group resigned today.
The resignation of Anadi Rout, president of the Joint Action Committee (JAC), apparently came after resentment brewed among leaders that contractors from outside would be employed for setting up the boundary wall of the project.
The resentment gained ground as some members alleged involvement of a kin of the JAC president in engaging an outsider as contractor on his behalf, sources said.
Officials of state-owned Industrial Infrastructure Development Corporation (IIDCO) and contractors last night visited Polanga and Noliasahi villages under Gadakujanga panchayat for laying the foundation for the boundary walls.

This socalled Pro-POSCO JAC, after all, is a gang of tekedars out grabbing profitable contracts at the upcoming POSCO Steel Plant!

NAC’s check list
Does it discourage forced displacement?
Does it minimise adverse impacts on people, habitats, environment and biodiversity?
Does it minimise adverse impacts on food security by actively discouraging acquisition of agricultural land, and promoting local economies?
Does it comprehensively define project affected persons/families?
Does it provide for a just compensation and rehabilitation package, sensitive to the aspirations, culture, community, natural resource base and skill base of the affected people?
Does it ensure humane, participatory, informed, consultative and transparent process?
Does it provide for effective implementation?
“The test for any such legislation should be on these parameters,” said the letter sent by the NAC to the government.
Additions to be made to the above:
01)  Does the project development ensures Eco-Balance of the Micro-Climate?
02)  Does the project development ensures al-round development of the region?
03)  Does the project development ensure the inclusive-growth of all the stake-holders, with the equitable distribution of wealth?
