In a major embarrassment for security forces in Jammu and Kashmir, the encounter in which a top LeT militant from Pakistan was said to have been killed was allegedly fake and the victim was a civilian.

A Special Police Officer (SPO) and an Army Jawan who allegedly staged the killing of an unidentified mentally-challenged civilian from Rajouri as part of a conspiracy to gain personal benefits were arrested and booked for murder, police said.

Chief Minister Omar Abdullah said the two men - SPO Noor Hussain and Territorial Army Jawan Abdul Majeed - are in police custody and charged with 302 (RPC).

"I assure that law will follow its own course," he said in Srinagar.

In Poonch, SSP Ashkoor Wani told reporters that SPO Noor Hussain and the Jawan Abdul Majeed were arrested today for carrying out the fake encounter by murdering a civilian and calling him divisional commander of Lashker-e-Taiba Abu Usman.

"A case has been registered against the SPO and Jawan of 156 Battalion of Territorial Army under section 302 Ranbir Panel Code for conspiring to murder a civilian and misleading security forces and police," he said.

Col A. Arora, spokesman, Nagrota-based 16 Corps, said: "Army has ordered an independent inquiry and prompt and stern action will be taken if any individual is found guilty".

Brutes like them must be hanged to death; it is degenerates in the Security Forces who bring disrepute to the whole of Indian Security Forces of brutality against the innocent citizens of Kashmir!!

People were incensed by the presence of Deputy Superintendent of Police.

Eighteen legislators of the opposition People's Democratic Party (PDP) on Tuesday bore the brunt of mob anger at Sopore town, which observed a complete shutdown for the third consecutive day to protest the custodial “killing” of Nazim Rashid Shalla (28).

The legislators, led by Moulvi Iftikhar Ansari and including Deputy Speaker of the Jammu and Kashmir Assembly Sartaj Madni, who sought to visit the house of the youth were attacked with stones but luckily none of them got hurt. Security guards opened fire in the air, eyewitnesses said.

As they approached Nazim's house, the people prevented them and also locked the door, an eyewitness told The Hindu. Sensing trouble, the PDP leaders beat a retreat but they were followed by the irate mob which threw stones and virtually chased them away. Their cars were damaged and four of them travelling in a Safari had a miraculous escape. One of the guards opened fire in the air and cleared the way for the legislators. A security guard was injured in stone throwing.

Sources said people were incensed by the presence of a Deputy Superintendent of Police, who was supposed to have been arrested in connection with the custodial death. Sopore SP Altaf Khan and four other police officials had accompanied the PDP leaders.

The government has since shifted Mr. Altaf Khan to ensure fair investigation in the case. He has been replaced by Ganderbal SP Imtiaz Hussain. The decision was taken at a high level meeting chaired by Minister of State for Home Nasir Aslam Wani, an official spokesman said.

Later talking to journalists here, Mr. Ansari said the people were angry on seeing the police and they shouted, “Those who killed Nazim are accompanying you.”

“Their anger is genuine and it is against the system of which we are part,” he said adding the National Conference-led coalition government had failed to protect the people and their lives. “Kashmir is virtually a jail where no dissent is tolerated. Police stations are filled with youth who are being harassed continuously.”

Chief Minister Omar Abdullah on Thursday said Pakistan will have to talk to mainstream politicians also if the leadership of Jammu and Kashmir is to be included in dialogue between New Delhi and Islamabad for resolution of Kashmir issue.

“If they want inclusion of Kashmiri leadership in the dialogue, then Pakistan will have to talk to the mainstream leadership also,” Mr. Omar told reporters on the sidelines of a function here.

He said separatists were not the only leaders in Jammu and Kashmir as the mainstream political parties have proved their representative character from time to time.

Mr. Omar said there was nothing to worry about the meeting between visiting Pakistan Foreign Minister Hina Rabbani Khar and separatist leaders in New Delhi on Tuesday.

“There is nothing new in Hurriyat Conference leaders meeting Pakistani dignitaries. This is not happening for the first time and there is nothing to worry about,” he said.

Responding to questions, the Chief Minister said he was satisfied that Foreign Ministers of India and Pakistan discussed confidence building measures in respect of Jammu and Kashmir and also resolved to strengthen these.

Ghulam Nabi Fai, the Indian Kashmiri who became an American citizen and ran a covert propaganda ring for Pakistan’s ISI out of Washington before his arrest by America’s Federal Bureau of Investigation four days ago, was a man of some standing in Jamaat-e-Islami circles in Kashmir, although he successfully concealed this in the US.

He was an organiser and a participant at a “secret” meeting in Kathmandu on January 14, 1990 called to decide a crucial question — the relationship of the Jamaat-e-Islami, which propagates rule according to the Shariat, with the recently formed Hizb-e-Islami, which would soon establish itself as Kashmir’s most feared terrorist group that turned its guns as easily on fellow Kashmiris of other groups as on India’s security forces.

A remarkable aspect of this meeting was that it was attended by Hakeem Ghulam Nabi, Abdur Rashid Turabi, and Prof. Khursheed Ahmed, leaders of the Jamaat-e-Islami from Kashmir, PoK and Pakistan respectively. The political conjuncture was grim.

Pakistan’s President, General Zia-ul-Haq, was dead, killed in an air crash about a year and a half before.

He had done everything to bring the Jamaat of Pakistan and PoK in a close embrace with the Pakistan Army and the ISI. All three had been tasked to bring on board the Jamaat-e-Islami of Kashmir to send its boys to PoK and Pakistan for military training.

Gen. Zia was using the Afghan jihad as a “smoke screen” to commence the Kashmir “jihad” and supplying the latter with funds and weapons provided by America and Saudi Arabia.

But the Jamaat in Kashmir feared becoming a target of the Indian authorities, and was reluctant to be drawn into an armed struggle against India. However, for the ISI, time was running out, suggests Arif Jamal, a well known Pakistani journalist, in his recent book Shadow War: The Untold Story of Jihad in Kashmir.

Calls for action against policemen who released medical report on rape victim

Even as the Kashmir Valley observed a complete shutdown on Saturday protesting against the alleged rape of a young woman in Kulgam, Communist Party of India (Marxist) leader Brinda Karat demanded an impartial probe, and also action against policemen who had released a medical report on the victim and a compact disk containing her statements.

Speaking to The Hindu, Ms. Karat expressed surprise at “the way police released the so-called medical report about the victim and also the CD”

“It is aimed at influencing the inquiry and the public opinion and it is reprehensible. The concerned officers should be suspended,” said Ms. Karat, who arrived here on a two-day visit as part of an 11-member consultative committee of MPs on women's empowerment

It was unethical and unlawful to disclose the identity of the rape victim, she said. “How can they do this and violate the protocol set for such cases.” The police action was highly provocative. “We will have to wait for investigation but it has to be independent.”

The rape controversy took a new turn when the husband and mother-in-law of the woman claimed before police that she suffered from mental illness and was at her home in South Kashmir on the day she claimed she was sexually abused.

The statement of the family members of Ruqaya, 32, goes contrary to her claim that she was picked up by two men in uniform on July 19 and allegedly gang-raped for two days before being let off on July 21.

In her statement to the Special Investigation Team (SIT) yesterday, Amina Bi, mother-in-law of the alleged victim, said that her daughter-in-law went missing on the morning of July 20 and not evening of July 19.

"She (Ruqaya) had gone to a spring at 7.00 a.m on Wednesday (July 20) and did not return till late in the evening. We sent people in different directions but could not find her. She returned home the next day," Amina told the SIT officials.

There have been, indeed, some instances of excesses by the uniformed forces, in Kashmir;

And it has become a convenient ruse for everyone to take recourse to the accusations for their unexplained absence, from home!

And there are certain secessionist sections in Kashmir who take advantage of these kind of false accusations to take to streets, some times with violence!!

Protests erupted in Damhal Hanjipora area of Kulgam district on Thursday after a 22-year-old woman alleged she was abducted and raped by two armymen. The police have lodged an FIR against two unnamed army personnel. Shafaqat Watali, deputy inspector general, south Kashmir, told 

HT, the woman, a resident of Manzgam village, around 100 km from Srinagar, had said the incident occurred on Tuesday. The men, according to her, belonged to 66 Rashtriya Rifles.

“First she accused some unnamed army personnel of abduction and rape. Then she retracted her statement and accused a local,” said Watali.

Kupwara:  All the four members of a family taken hostage by militants in Kupwara district of Jammu and Kashmir on Thursday have now been rescued.

The encounter though is still on; three militants are believed to have been killed in the encounter. There is no confirmation about it.

Five soldiers have been injured in the incident.

Kupwara:  All the five members of a family taken hostage by militants in Kupwara district of Jammu and Kashmir on Thursday have now escaped unhurt.

According to sources, police was tracking a group of militants for the last 15 days. Last night, five of them entered a house in Lolab in Kupwara. There were five people in the house - three children, a man and a woman. While the children and the man came out early this morning, the woman escaped at around 9 am.

These cross-border terrorists sneak into J&K and create havoc with the lives of innocent civilians!

An ongoing gun-battle between security forces and militants that broke out in south Kashmir's Pulwama district on Friday night has left two Jash-e-Muhammad (JeM) militants dead and an army major injured. The shootout started previous night when the army's 44 Rashtriya Rifles (RR) and the police's special operation group (SOG) threw a cordon around Bongam village of Hanjan in Rajpora area, Pulwama district, 45 km south of Srinagar. The operation was launched after a tip-off about the militants' presence in the area. The hiding militants spotted the security forces' cordon and fired volley of bullets at the personnel to break through the security ring.

"Police and the army have killed two militants so far in the encounter," said a Srinagar-based police spokesman. In the exchange of fire, an army major also received injuries.

Army's Srinagar-based spokesman JS Brar said that the two militants belon to the Jaish-e-Mohammad. The militants, who had taken refuge in a built up area, were asked to surrender but they opened fire resulting in a fire fight," said Brar.

Pakistan has reserved 12,000-14,000 fully-trained Kashmiri militants who would be used against India in case of a war, The New York Times has quoted a former militant commander as saying.

The paper quoted the unidentified commander saying that Pakistan's military is still training militants to carry out proxy wars in Kashmir and Afghanistan.

The commander added that militant groups like the Lashkar-e-Taiba, Harkat-ul-Mujahideen and Hizbul Mujahideen are run by religious leaders, with the Pakistani military providing training, strategic planning and protection.

At least six policemen were injured today when militants triggered an IED explosion near a police station in Sopore in Baramulla district in Jammu and Kashmir, officials said.

Militants fired a rifle grenade at around 9.05 am, which landed and exploded in the police station premises, the officials said.

SRINAGAR: A major tragedy was averted when Jammu and Kashmir police recovered five kgs of improvised explosive device ( IED) filled in a tin container planted outside the state-owned Heemal hotel on Boulevard road on the banks of Dal Lake.

According to the police, pedestrians noticed the unattended container and informed the police at about 10am on Thursday morning.

The bomb disposal squad from Srinagar police control room immediately swung into action and defused the explosive, the police spokesman said.

A day ahead of crucial Indo-Pak talks on the Kashmir issue, Prime Minister Yousuf Raza Gilani on Thursday described Kashmir as the ‘jugular vein of Pakistan’ and assured the Kashmiri people of his complete political, diplomatic and moral support.

Gilani made the remarks while addressing a public gathering at Palandri in Pakistan-occupied Kashmir.

The ruling Pakistan People’s Party and the Kashmir issue have a deep relationship, the premier said.

The Foreign Secretaries of India and Pakistan, who began two-day talks here on Thursday, are scheduled to discuss the Kashmir issue on Friday.

Their talks today focused on peace and security issues, including terrorism and the trial of Pakistani suspects linked to the 2008 Mumbai attacks.

As he even spoke of waging war for 1000 years; he knows what he was talking was only for the Pakistani public and as a prelude to the Foreign Secretaries Meet!

This again, to dodge queries relating to the 26/11 Mumbai Terror Planners being sheltered, there!!

What a pity, coincidentally, Pakistan requires another 50 generations to overcome the terror gangrene they have inflicted upon themselves!!!
