An attorney for the accused butcher of Brooklyn boy Leiby Kletzky abruptly resigned Thursday night, saying his conscience prevented him from going on.
Gerard Marrone, one of two attorneys defending Levi Aron, said he bowed out because of "the horrific way this boy was killed."
"I have three little boys," he said. "You can't look at your kids and then look at yourself in the mirror, knowing that a little boy, who's close in age to my eldest son, was murdered so brutally."
As Aron was left with one attorney, Pierre Bazile, legal experts told the Daily News the suspect is eligible for the federal death penalty because he took Leiby across state lines.
"That crime is punishable by up to life in prison or the death penalty," said former federal prosecutor Morris Fodeman.

For a couple of hours on Monday night, Leiby Kletzky, 8, sat in a car outside a catering hall in Rockland County, N.Y.; the windows were rolled down, if the man suspected in his killing is to be believed.

More than 400 people were at a wedding inside the hall, including the man who had driven Leiby there, Levi Aron, 35. No one apparently noticed the little boy sitting there on the warm night. And no one knew then that Borough Park, Brooklyn, was mobilizing to find him.
Leiby was 35 miles from home, where his world was defined by family and religion and community and Mr. Aron’s by dead-end jobs and marriages that fell apart. They encountered each other on a sidewalk in Borough Park, one a lost child who needed directions, the other an adult from nearby Kensington who indicated he could help.
On Thursday, three days after they met on the sidewalk, the police were trying to sort through Mr. Aron’s account of how he had met the boy, and what had happened during the undetermined time that they spent together before the boy was suffocated and dismembered.
Mr. Aron appeared in Brooklyn Criminal Court and pleaded not guilty to charges of kidnapping and murdering Leiby. Judge William Miller ordered him held without bail and said he would have to undergo a psychological evaluation after his lawyer said Mr. Aron might have mental problems.

Levi Aron told police that he took 8-year-old Leiby Kletzky to a wedding in upstate New York after the boy became lost Monday while walking to meet his mother.
Leiby’s disappearance set off a frantic two-day search that ended Wednesday with the grim discovery of his dismembered bodyinside a refrigerator in Aron’s apartment and in a Dumpster.
At a press conference Thursday, New York City Police Commissioner Raymond Kelly said detectives confirmed that Aron attended a wedding in Monsey, N.Y., on Monday. Kelly said that wedding guests and workers at the catering hall did not see the boy.
Leiby had encountered Aron on a street corner in Brooklyn’s Borough Park section around 5:30 p.m. Monday after becoming lost while walking to meet his mother seven blocks from his Brooklyn summer camp. Although Aron told police that Leiby went with him willingly and remained with him voluntarily, Kelly said that ligature marks on the boy’s wrist may indicate the boy was held against his will.
Aron told detectives that he first met Leiby when the boy was asking for help finding a religious book store. When they couldn’t find the store, Aron told detectives the boy agreed to accompany him to the wedding upstate.

Suspect known in B'klyn as weird around children.

Brooklyn loner Levi Aron gave people the creeps long before he was charged with slaughtering an innocent child.

The 35-year-old plumbing-supply store stockboy made his neighbors' skin crawl with the rides he gave neighborhood kids in his clunker Honda Prelude and the way he'd stare at local elementary-school students in a playground.

"The parents on the block wouldn't want their kids to go near him," said a neighbor, Chaim Lefkovitz, 39, who added that Aron was prone to furious outbursts.

"Sometimes he would just get angry out of nowhere," Lefkovitz added. "He was one of those people you stayed away from."


A family acquaintance, Lee Vogel, 21, said, "There was something strange about him. You know when you see Charles Manson, he has that look in his eye? Levi had that look."

Although Aron freaked out people who knew him, the only blemish on his record was a summons for public urination last year.

He worked at a job that paid just above minimum wage at Empire State Supply Co. in Borough Park. His boss called him a "quiet" but good worker.
