A fresh attempt is being made to build consensus within the Government to amend the controversial Armed Forces Special (Powers) Act (AFSPA), Home Minister P Chidambaram indicated today.

"I am trying to revisit AFSPA but as you know one needs to build a consensus within the government before amendments can be brought before Parliament," Mr. Chidambaram said while replying to questions after presenting the monthly report for his Ministry.

"We are trying. You know we have tried in the past," he said during the press interaction on being asked whether AFSPA could be repealed in Manipur and Jammu and Kashmir.

He said in J and K there was a consensus within the Central Government that if the state withdraws the Disturbed Areas Act, AFSPA will automatically go.

"You know that in Kashmir, we have asked the state government to review the application of Disturbed Areas Act and if that act is reviewed, then automatically if the DA does not apply to areas in Kashmir, the AFSPA is not applied to that area in Kashmir.

"So we took that route in Kashmir. In Manipur, the demand is that AFSPA should be repealed. There is a Jeevan Reddy committee report. We have discussed this a couple of times.

"As I said, there is no consensus yet and I am trying to build consensus..I have not succeeded so far. There is a statement of the Prime Minister (Manmohan Singh) that we will replace the AFSPA with a more humane act. So we are trying," he said.

The army has conveyed its apprehensions to the Defence Ministry that replacement of AFSPA or any dilution could hamper its operational capabilities to effectively deal with militancy and insurgency.

"On the first route (in JK) there is a consensus at the Centre. Now at the operational level, the JK govt would have to, in the Unified Command, agree to review the application of Disturbed Areas Act.

"If they are able to lift the DAA from, say five places, then AFSPA would not apply to those five places. So that is something which they have to do and I am in touch with the Chief Minister (Omar Abdullah)," Mr. Chidambaram said, adding Mr. Omar has to "weigh the pros and cons and then decide when to do it, where to do it. That is for them."

Omar's government in the state has already constituted a Committee earlier this year to review the DAA. The Committee comprises Director General of Police, Home Secretary and Corps Commander of 15 Corps (for Kashmir) and Corps Commander of 16-Corps (for Jammu).

The Committee has met twice so far and is expected to meet again next month.

The AFSPA gives the Army the powers to detain and, if the situation warrants, eliminate suspected terrorists when they are fighting insurgents without the fear of prosecution.

The Act is only in force in some areas in Kashmir and insurgency-affected states in the north east.
The Second Administrative Reforms Committee had suggested to the government replacing of the Act with an amended law which gives the Centre the right to deploy the Army or para-military forces in situations involving national security.

Prime Minister Manmohan Singh and Home Minister P. Chidambaram on Tuesday gave two entirely different versions in the Lok Sabha on the reasons that prompted the police to move the magistrate to review his earlier order to remand social activist Anna Hazare and his supporters in seven-day judicial custody.
In his statement to the House, Dr. Singh said the police approached the magistrate on the basis of information ‘received' that Team Anna intended to move the Supreme Court challenging the police orders and the petition was likely to be mentioned before the apex court on Wednesday for urgent hearing.
Responding to the discussion on the Prime Minister's statement, Mr. Chidambaram conceded in response to a specific question by JD (U) leader Sharad Yadav that it was a “political decision” on his advice to the Police Commissioner. “When we heard that Shri Annaji has been remanded in judicial custody, I advised the Delhi Police Commissioner in the evening to go back to the magistrate to get the order reviewed,” Mr. Chidambaram said.
Dr. Singh in his statement said: “Late yesterday [Tuesday] evening, the Delhi Police received information that Shri Anna Hazare intended to move the Supreme Court challenging the orders of the Delhi Police. The Delhi Police also received information that the petition was likely to be mentioned before the Supreme Court on Wednesday, i.e. today, for urgent hearing.

Gujarat chief minister Narendra Modi on Saturday shot off a letter to Prime Minister Manmohan Singh complaining against Home Minister P Chidambaram's comment on the issue of IPS officers, alleging that the UPA government is trying to destabilise his government.

"Congress-led UPA government is trying to destabilise the democratically elected government of the state of Gujarat," Modi said in the letter written to the Prime Minister.

"Home Minister's (P Chidambaram) comments made yesterday were aimed at promoting indiscipline in the police force of the state," Modi said.

Modi has sought the prime minister's intervention in the matter, saying that those who are making such comments should be told not to do so.

His letter to the prime minister comes after Chidambaram's remark on Friday that the Centre could intervene on the issue of IPS officers of Gujarat if the affected officers want so.

"Rules do provide for central government to take certain decisions at certain stages but that stage has to be invoked by officer concerned. If officer concerned invokes the rule, certainly we will look into it," the Home Minister said.

The Gujarat government has suspended IPS officers Sanjiv Bhatt and charge sheeted another senior officer Rahul Sharma who have spoken against it over the 2002 riots.

Faced with a ticklish situation, the government on Friday threw the ball in the court of the political parties in Andhra Pradesh for a decision on the issue of separate state of Telangana.

Responding to a Calling Attention Motion on the Telangana issue, Home Minister P Chidambaram told the Lok Sabha that as many as four political parties of Andhra Pradesh out of eight have not yet “made up their mind” on Telangana.

Three parties — TRS, BJP and CPI — favoured carving out of the new state while CPI (M) is opposed to the idea, he said.

The parties which have not made up their mind are the ruling Congress, TDP, YSR Congress and MIM.

“Kindly make up your mind fast,” Mr. Chidambaram asked the four parties which are undecided.

Madras High Court dismisses P Chidambaram's 2009 election petition!

Chennai:  The Madras High Court has dismissed a petition by Home Minister P Chidambaram against a plea challenging his election in 2009.

In his application, Chidambaram had contended that there were some defects in the petition filed by his immediate AIADMK rival R S Raja Kannappan Kannappan, who lost the election by just 3,354 votes.

Chidambaram had claimed that the high court registry had noted the defects when the petition was filed by Kannappan. 

Dismissing Chidambaram's application, Justice K Venkatraman said, "There cannot be any doubt that an Election petition filed with defects which cannot be curable cannot be considered as an election petition at the end. However, in the case on hand, the defects pointed out by the officer concerned are not defects which are not curable warranting dismissal of the election petition."

Kannappan in his petition filed on June 25, 2009 alleged that Chidambaram's election 'deserved' to be declared void due to 'manipulation' of votes and 'corrupt practices' committed by him, his election agents and others, with his consent.

A cornered former communications minister A. Raja on Tuesday briefly argued his own case in the CBI court, asking why he alone was being prosecuted for the 2G spectrum scam.
His lawyer Sushil Kumar was referring to the solicitor general when Raja, a lawyer by training, looked at judge O.P. Saini and asked: "May I?"
When the judge nodded, Raja took on his own defence, loudly and aggressively. The packed courtroom suddenly became very silent, eager to listen to what the now jailed DMK leader had to say.
And he did have more to say.
'The Prime Minister is guilty too'
"All my predecessors maintained the same policy which I worked on," said Raja, wearing his usual white shirt and black trousers.

'Release me now'
47-year-old Raja, who is behind bars for nearly six months, said he deserves to be discharged from the case as the allegations against him are not established at all.

Eversince the 2G Spectrum Scam came out in the open, I have been contending that by not monitoring the activities of A. Raja, when warned by many of his colleagues, Dr. Manmohan Singh and Mr. P. Chidambaram in his capacity of both the Finance Miniser of the date and as well as the Chair of the GoM for Spectrum Sale are guilty of 'Omission of Duty' as required by his constitutional obligations!

In an apparent relief to union Home Minister P. Chidambaram, the Supreme Court on Monday declined to issue notice to him on a plea that he sanctioned the police crackdown on yoga guru Baba Ramdev and his supporters post midnight June 4.
An apex court bench of Justice B.S. Chauhan and Justice Swanter Kumar, while declining to entertain the plea by Baba Ramdev, said that the court was not inclined to broaden the focus of the inquiry and wanted it to be limited to the post-midnight police action.

Indian intelligence agencies received no warnings before the three bomb blasts that killed 18 people in Mumbai, the biggest attack since Pakistani-based militants rampaged through the financial hub in 2008, Home Minister P. Chidambaram said on Thursday.
Suspicion however fell on the Indian Mujahideen, a shadowy home-grown militant group known for its city-to-city bombing campaigns using small explosive devices planted in restaurants, at bus stops and on busy streets.
"There was no intelligence regarding a militant attack in Mumbai. That is not a failure of intelligence agencies," Chidambaram told a news conference today.
"Know that perpetrators have attacked and have worked in a very very clandestine manner. Maybe it's a very small group, maybe they did not communicate with each other."
He also said it was too early to point the finger at a particular group, but said the 'coordinated terror attacks' could be in retaliation to a number of plots recently stopped by police or the arrests, including from the Indian Mujahideen.

Mumbai:  Home Minister P Chidambaram is holding a press conference in Mumbai on the three serial blasts that killed 17 and injured more than 130 people last evening. Here are the points stressed by him in his language:
  • 17 deaths confirmed . We have found one severed head that has been identified...that will take death toll to 18.

  • Do not rule out an attempt to derail Indo-Pak talks.

  • Not an attack on India's commercial capital. They (terrorists) chose the places because of the density of the population and the congestion in those areas.

  • No intelligence failure but perpetrators worked in very clandestine manner. There may be a very small group involved.

  • No intelligence input for yesterday's blast to central or state agencies - this is unfortunate.

The CBI, which is probing possible criminal aspects in the allotment of spectrum licenses since 2001, has collected details of certain correspondence between the finance ministry and the telecom ministry on the issue of “spectrum pricing” during the tenure of former communication minister Dayanidhi Maran.
The agency is probing the allegation that DoT ignored suggestions made by the department of economic affairs (DEA) over spectrum pricing during Mr Maran’s tenure, sources said. The CBI officials recently visited DoT office and collected all relevant documents in this regard, sources added.
“The CBI is also probing the allegation that the DoT did not discuss the issue of determining the entry fee for telecom licence with the finance ministry during Maran’s tenure. The agency is planning to question some DoT officials also in this regard,” sources said.

Well there definitely is culpability of both Omission and Commission on the part of the then Finance Minister, P. Chidambaram and he needs to explain a lot to the Nation!

NEW DELHI: After Mamata Banerjee became the chief minister of West Bengal, she parked her close party aide MoS Mukul Roy in the Railways.
She has since been lobbying to get Roy elevated to a Cabinet rank, but the PM seems to have put his foot down. So Sonia Gandhi had a chat with Mamata to convince her to relinquish the Rail Bhavan. This was when she was in the Capital last week. But, sources said, she refused to do so saying that she needs the Railways for development of West Bengal.
Now another TMC man, MoS for Health Dinesh Trivedi is the front-runner.

Mamata's fixation with Railways Ministry beats the logic; UPA better appoint Railways Minister for West Bengal and another for the rest of India!
